On the one hand, Rahul Gandhi has a statutory right of appeal after his conviction by a Sessions Court. But, on the other hand, the disqualification that follows his conviction has immediately happened. Is this an anomalous situation? Is this a result of a lacuna in the law? What happens if Rahul Gandhi’s conviction is stayed by the appeals court? By then his disqualification will have already happened. Can it be reversed?
