In 1816, Congress passed an act that incorporated the Bank of the United States. In 1817, the Bank opened up a branch in the state of Maryland (plaintiff). In 1818, the Maryland state legislature passed an act to impose a tax on all out-of-state banks operating in the state of Maryland. Although the act was general in nature, the Bank of the United States was the only such bank in Maryland at that time and was thus the only establishment affected by the tax. James McCulloch (defendant), head of the Maryland branch of the Bank of the United States (Bank), refused to pay the tax. This lawsuit ensued and the case was appealed to the Maryland Court of Appeals. The court of appeals upheld Maryland’s argument that because the Constitution was specifically silent on the subject of whether the United States government could charter a bank, the Bank of the United States was unconstitutional. The case was then appealed to the United States Supreme Court.

Here is a summary for everyone asking :) McCulloch v. Maryland Summary: A battle to settle constitutional proportions between states and Federal government. James McCulloch refused to pay the $15, 000 for the out of state taxation for the bank for Maryland. Leading Maryland to sue McCulloch in Baltimore county court. The court sided with Maryland and made him pay it. He lost in Trial, Court of Appeals, and with all, he still petitioned for the supreme court to review. Court states that congress had the right to make the bank, and the states cant taxes it. John Marshall put “The Necessary and Clause Act” into play. This allows Congress to make the laws necessary and proper to do and express powers. Marshall held that a federal bank was useful to pass around money, still giving congress authority to power. In summation, John Marshall makes a final conclusion that “It'd be inappropriate for a federal bank to be subject to the taxes of one state.” Maryland tax was made unconstitutional. All in all, McCulloch won.

4:16 They make it sound like the indictment against McCulloch was politically-motivated! McCulloch was guilty AF. He was an embezzler. He got off because laws against embezzlement did not exist at the time. :D
