Court Rejects Rahul Gandhi's Request To Pause Defamation Case Conviction

In a massive setback for Rahul Gandhi, a court in Gujarat today rejected his request to pause his conviction in a defamation case over his 2019 "Modi surname" remark. This means Rahul Gandhi cannot be reinstated as Member of Parliament for now.

First — His speech that day made complete sense and was the truth! He was talking about demonetization and GST which is a disaster in itself affecting common man and small businesses, and how crony capitalists and politicians like Amit Shah benefited. RBI had advised against it because ~ 97% of black money is almost always converted into immovable assets in India.

Second — Also defamation law 101 states that references to a generic class of people are not actionable unless an individual can show a direct reference to "themselves” which is not the case here! And anyways most of godi media wrongly translated the speech saying Rahul said as: “all thieves are named Modi.” or “All the thieves are Modis.” The actual translation is: “All *these* thieves are Modis.” He asked: “Why are *these* thieves named Modi?” instead of asking how every thief is a Modi. Here *these* = Nirav, Lalit & Narendra. There’s a world of difference here!! Explicitly, 3 people are named who happen to have the surname, Modi. With a possibility that if you look further, there might be a few more Modis. He didn’t say that every thief you find will be a Modi.

Third - Fattu chaiwala did not want him to speak in the parliament about Adani because he is very much siphoning public money to his fraud friends like Adani who are putting it in foreign fake companies; and funding BJP and RSS to spread false news, hate and fear for pure political gain. So he dismissed him from parliament and that too without any discussion/direction from the president which is what the law states!

The game is simple - Modi feeds the likes of Adani & Ambani to the scale that some become the richest in the world using public money - and in turn they fund the RSS and BJP who openly peddle fake news, fear and hate for political gain. This divisiveness also blinds people from the real issues!

A country should at basic make you feel secure and safe; and with Modi & RSS a lot of people just don’t anymore! All religions promote love, but when it is used as a tool for political gain, it shows a lack of respect and disregard for its true values.

People say Modi is developing infrastructure, but at what cost? Unemployment is at its highest, GDP to Debt ratio has doubled in Modi’s term! Profitable government businesses are being sold to private companies run by Modi’s friends! While private companies may make them efficient, the profit then CANNOT be used for public welfare; Instead, it would make the rich more rich who intern fund the BJP/RSS agenda of instilling religious fear. People like Adani even moving this money outside the country into shell companies for business gains. What’s the use of building a luxurious roof if your foundation is getting eaten by termites - if you’re breaking the very foundation of democracy & India!

People question RaGa’s eligibility to become a PM when they should question Modi’s - who is undermining the basic definition of a country and democracy. Anything & anyone is better than Modi & RSS.

As the Criminal appeal against the conviction and sentence of CJM, Surat against Mr.RahulGandhi is pending, no legal impediment if the conviction is stayed till the disposal of appeal because it's a legal obligation available lawfully to the accused, When appeal has been admitted, then stay of conviction is his right

When the appellate Session court dismissed the stay petition as against the conviction till the disposal of appeal, it pushed to infer that he has not seen any merits in the appeal too at the first look, that's why he denied to consider the interim relief of stay petition. So the legal team of Congress to move the Supreme court to transfer the Criminal appeal to some other state, or to approach the High court to transfer the appeal to some other Sessions court

The Gujarat courts have lost their credibility and have brought shame for judiciary since 2002. No more people are going to believe and the judiciary will be responsible if there is anarchy in Gujarat and other states.
