So, I am not a lawyer but I do know a thing or two about copyright claims. These claims are similar enough that the court will probably agree that they warrant scrutiny, but I think it's highly unlikely this suit really goes anywhere. The similarities are because both works are using the same or similar tropes, which are not subject to copyright. The Red War story line is similar to hundreds of other stories written before it, quite honestly a comparison to Star Wars wouldn't be amiss. I have not read the works of Martineau, but I would be greatly surprised if a jury (as he is requesting one) found any wrongdoing on the part of Bungie. Pick any two stories in the world and you can find similarities, the burden of proof in a copyright case is to prove beyond reasonable doubt the works are substantially similar such that the expression of the ideas must have been copied. Even in the examples provided by Mr. Martineau I, personally, do not find there to be substantially similar expressions of the ideas outside of the framework provided by the tropes. Are they similar? Yes, as similar as any two works that rely on the same tropes are. Similar enough to prove copyright infringement by Bungie? I highly doubt it. I'll spare you the dressing down of the specific claims, but suffice it to say I believe Bungie's legal team shouldn't have any problems dismantling the suit should they choose not to settle outside of court

The cabal storyline was completely based off of Roman history, including the rise of ghaul and the red legion as a parallel to the Roman Empire after the assassination of Julius Caesar. So homie thinks that he can copyright well know history from 1500-1700 years ago, and then sue someone else for using ideas that are vaguely similar to his own. And on top of that he’s almost 8 years late to this, homie is grasping at straws.

“Outcast rises to power through their own conviction and sacrifices” - like 90% of villains

“Bad guy uses power to try and take over earth” - also like 90% of villains

Transferring consciousness to a robot body or something similar - been in sci-fi forever

A “failsafe mechanism” is much different than a video game character named “failsafe” who you can actually interact with and who gives you missions

The only thing I’m seeing here is both factions being named “red legion” but hard to confirm which came first

The dude is not gonna win, the red legion and the cabal have been in the concept art since before 2014 being shown in concept in 2010 where in some of the art you see concepts for the red legion, war beast, cabal soldiers, and even a version of the almighty. The plaintiff is trying to hussle the court system to make bungie pay for damages that are superficial. The plaintiff should be worried that bungie has grounds to counter sue the plaintiff for plagiarism, and stealing of assets that do not belong to the plaintiff. Not to mention the story he has written for his narrative are completely different in the grand scheme, one is based during Roman times the other is based in the 27th-28th century. Bungie is going to get this case either thrown out or go after the plaintiff and have him charged

@2:08 The Red Legion was first alluded to in the taken king after the Cabal Shield Brothers failed to blow up the dreadnaught. The sent out a distress signal in the last mission in the taken war campaign.
