Honest with you if somebody takes a picture of the Eiffel Tower at night and posted online and they get sued for it. What's the average person going to realize it's a copyright image when they're taking the photo

why is it illegal to take the photo if you are not gonna share?

i understand that sharing should be illegal, but taking the photo doesn't automatically mean you are gonna share it, and if it's not illegal to see it with your goddamn eyes, then it shouldn't be take a picture of it. it's illogical, and illogical things bug me very much.
