How to safeguard against Section 498A

Section 498A of the IPC states that “Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine. The offense is Cognizable, non-compoundable and non-bailable.  “ Most cases where Sec 498A is invoked are false cases filed by the wife (as repeatedly admitted by the SC and the HC's) in an attempt to defame and extract money from the husband in the face of a strained marriage. But there is no need for panic.

An FIR wont be rejected straightaway and will be reported to CAW cell where you will be given a notice for appearing. Only if a settlement is not reached can the FIR be filed. In this case one would have to apply for anticipatory bail. But even after that the police has to have the permission of the ACP and the DCP before arresting any of the members of the husband's family.

498a pota क़ानून के जैसा है। बेहतर हो कि जिनलोगों पर 498a लगे उनलोगों को आतंकवादी हीं घोषित कर दिया जाय। 498a का मक़सद तब अपने रास्तों से भटक जाता है जब बिना किसी भी प्रकार की हिंसा किये एक व्यक्ति की स्वतंत्रता का यह अपहरण कर लेता है। तब शुरू होती है एक बेइंतिहा ज़ुल्म की नुमाइश।
एक सभ्य समाज में, तब जब कि युवाओं की संख्या में हमारा देश अन्य देशों से आगे है, तब जबकि हमारा भविष्य दाव पर लगा हो, तब जबकि हम विकसित देश की कतार में ख़ुद को देखने के लिए होड़ कर रहें हों, यह कानून अपनी प्रासंगिकता खो चुका है।

498a WAC cell me FIR se pehle mere bhai ne counseling me settlement kar liya or us complaint me mera bhi jhoota Naam likhwaya tha to kya me defermation manhani ka case kar sakta hu kya us ladki ke khilaf?

Sir. My wife filed a false 498A case in relatiation to our police complain when she and mother tried to kill me. Now the police has filed an FIR directly without any Counselling. I did not get any formal notice.

sir could you please give me case name where high court has given such order, that FIR can not be lodge straight away, CAW call and counselling/mediation is a must.

hello Sir,

I my case the FIR was registered directly without the matter went to the CAW cell.

No counselling was done before the FIR was registered, It was like a wake up call for us.

is law differ from state to state?

What if the case is genuine ?what to do if mother-in-law is really asking for salary and more property, violence and the husband is using all illegal means to change the documents, bribe the clerks, lawyers, and threaten women, , etc.Huband is not working, and puts false marriage profile, to trap working wife, and then beats her dialy to keep her in control. please don't project that all 498a are false. only those cases where wife wants her husband and file case if she wants to bend her husband in her own way is a false case. alll other cases are genuine, ok.most of the time who does not put cases are bad like My sister-in-law thereatens her husbands that she will file 498a, to keep him under control but never files.. Both my nanaths had kidnapped husbands, no dowry, no permission of in-laws . but for son, brother, , they took huge dowry from me and from first day started treating me badly. beating, toilet cleaning. Mother-in-law says "mera damaad hi salary mujhe detha hai, , tho thi kya chees hai"? ofcourse bad women purposefully chooses innocent men, working, " kamavu" and then traps them. If you have guts fight for those men who are innocent traps, , not the drackulas who suck the blood. and don't say all 498a are false
