SC jolt to opposition: Top court upholds ED's powers amid misuse charge on Modi govt

The Supreme Court has upheld the Enforcement Directorate’s power to arrest and seize properties under the Prevention of Money Laundering Act as it dismissed several petitions challenging the provisions of the law. A bench of Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar passed the order on a batch of 241 petitions challenging the validity of various provisions of the law. In its order, the court also held that Section 45 of the Act was legal and not unreasonable. The provision makes offences under the law cognisable and non-bailable. It also states that when a bail plea is opposed, the court needs to be satisfied that the accused person is not guilty and will not commit any crime after release. This comes even as the opposition continues to protest against the misuse of agencies by the Modi government. Watch this report to know more.

The attachment figures, ₹5346cr in the UPA era Vs ₹99, 356cr in the NDA era, reflects which dispensation is serious in curbing money laundering. The fact that the conviction rate is low is primarily due to the undue delay in trial in the courts. Case in point is the National Herald case which was filed by Subramanyam Swamy in 2013 when he was in the Janata party (joined BJP in 2014). Nine years later the trial of the Gandhi parivar is not complete and they are out on bail. Chief Justice NV Ramanna who has the habit of blaming everybody else except themselves should ask lower courts & High Courts to expedite hearings so that those found guilty are brought to justice. Navjot Sidhu's case took over 30 years for the victim to get justice.

ED deserves full support from everyone in conducting their national duty. Thanks to their efforts we are able to recover looted and hidden money by some atleast. ED should be further strengthened.

If ED does its work of eliminating the Money Laundering cases in India then people who are accused will definitely say Govt. is misusing ED. Because of ED the FATF is happy with India and it should be. India should not be a safe Haven for black Money.
