Am I off base to find at least two problems if a former president is ever charged based on current president waving executive privilege in a way that effects prior presidents?

1) it gives power over current president to arbitrarily make criminals of prior presidents.

2) When you do something In the past and it was legal, then you did it when it was legal. And if the law changes, then you can't be charged with a crime for something you did when it was legal.
