This reminds me of a story. A monkey stole a photographers camera and took pictures of himself. The photographer contacted authorities and got his camera back. He saw the pictures and posted them on the internet. A website used his picture of the monkey so he tried to sue but because the monkey took the pixture and not him he didn’t grt any money

You should do a follow up dealing with photographers and unsolicited photos or film. Since thats a pretty common thing with how many people walk around filming people to try and force shocks or interaction.

Question, if a picture is taken of you by someone without permission on private property would the one who took the picture still be the rightfull copyright owner or would the picture have no copyright protection?

I would say the photographer should have the rights to the photo, but if the subject didn't want their picture to be taken, then they should have the right to have the photographer delete the photo immediately after it was taken

It should be Illegal to photo/ record anyone without their permission. I can see an app where you record but ALL the faces are blurred/censored and the people in those videos get a notification about the location of the recording device as well as an option to unblur your face therefore giving permission to be uploaded onto the internet.
How I would love to not be on 23 different instagram accounts fully visible with no way of taking those pics down.

I think both the photographer and the person in the photo should have the rights of the photo but no one else should unless they get a license or ask permission

Best way to avoid this situation: If someone takes a picture of you, ask before posting it on your page, and make sure to give credit to the photographer

I feel the necessary change is that, consensual photos are default owned by the photographer but non-consensual photos are owned by the subject(s).

Well if the photographer takes the picture of you without your consent then you should be able to sue them for more money than they can sue you for for posting it online
