Overtime Pay
Under the Fair Labor Standards Act (FLSA), an employer is required to pay a nonexempt employee at least minimum wage and overtime pay for an hours worked over the standard 40 hour work week.
For each hour worked over 40 per week, the employee receives 1.5 times their regular pay.
These are federal guidelines and if the state guidelines are higher than 1.5 times regular pay, then the employee is entitled to receive the state's guidelines in terms of pay.

What about five 10 hour days? Do you get 2 hours overtime pay for the first 4 days then the 5th day is all overtime?

The way the do it at my job feels like a rip off! Our pay period starts on thursday so I can work Mon through sun and work 55 hours but as long as they give me a day off before next Wednesday then I don't get those overtime hours. It's not right. I work 15 hours of overtime and don't get paid for it all the time.
