For claiming any income as agricultural income, you've to prove that you used it for agricultural purposes in last 2 previous years.
Income tax department actually won a case when they asked ISRO to provide picture of that agricultural land of last 2 years and obviously since there was no farming on that land, assessee(person liable to pay tax) lost the case.

I know one person who showed his 40% income under the agricultural income column during ITR filing, (as he bought a 3 lands before) and thought of tax exemption under 54b but soon income tax caught him with satelite images, that the land was non agricultural 😅

Don't underestimate the power of section 10(1) of income tax. Government can't make such income taxable as we are agro grown country and because of which Income tax act has exempted the income from agricultural. Even if you sell and purchase the agriculture land you may get the deduction under section 54 which lead to 0 capital gain tax . So bhai log ye job vob chodo aur kheti badi karo kyu ki ager apki salary 10 lakhs se uper hui toh 30% tax lagega per agriculture income hoga toh chahe crs me kama lo 0 tax lagega 😂😂.

Central govt can't levy tax on agriculture income bcz it is exempted under section 10(1) of The income tax Act .But state govt can levy tax on agriculture income but they don't so bcz of political reason .The word farmer protects the big plot holders too.

But sir as far as I know if agricultural income is above 5, 000 and you have also other source of income then you have to pay the tax on the basis of slab rate. So, please explain how they avoid tax liability.
