With the ever-changing laws in regards to tenant/landlord and overall real estate policy, how can you avoid a potential lawsuit?

As we prepare for our 14th annual Apartment Owners' Educational Luncheon, today we invite attorney Steven Spierer of Spierer/Woodward/Corbalis/Goldberg as well as attorney Mike Brennan of the Brennan Law firm to discuss best practices when it comes to apartment ownership. Steven and Mike have a vast knowledge of both CA legislation and real estate law, and are on a mission to ensure Landlords are prepared for what is next. 

Prior to Covid, real estate law was already in flux given the enactment of rent control and various other policies. Within those bylaws were hidden and cryptic governances that could have easily been misinterpreted by an investor. Since then, it seems as if new laws in opposition to the rights of an owner continue to be unveiled by either the county or the state of California. Our goal is to educate all landlords on the do's and don'ts with respect to apartment ownership so that an unwanted lawsuit does not fall in their laps.

We are currently in a state of emergency. Claiming a "substantial remodel" without pulling permits (and have already offered tenant stay at 10% increase in rent, if not already done) will show your only getting the tenants out to raise rent. And that is price gouging. Under the law price gouging is $10k fine & 6 months in jail. Details matter.
You also don't want to give a tenant motivation to sue for substandard living conditions. If you say the property needs a "substantial remodel ", this implies that the property is so bad it needs more than a months repairs and uninhabitable. Tenants will only become more educated. Not less.

They need to build homes for people that can't afford to pay their rent and take care of them and not put the burden on landlords

Yeah it's unfortunate that the landlords will have to take some losses but they are in a business that has a number once effect of having a roof over people's heads. When you are doing more harm than good in a community there needs to be laws to protect people from being homeless. Shouldn't have to make laws but some people will never stop better if not enforced by a law.

I haven't been a renter in almost 30 yrs. I have never been a landlord. I would not like to see the mom-pop landlord go extinct. My best experiences with renting involved the human touch, the property owner or his on-site agent, in a complex of 10 or fewer units.

Great but I want to know if one tenant keep on harassing the next door tenant despite retraining orders. Can that tenant be evicted? The lease agreement has a clause of nuisance. Does this come under that clause.

What I don't understand these city leader's already are letting non paying tenants live free but now they can bring extra people in your place plus dog's cat's they you don't have on your lease tearing up your place you have to fix it up and the law's are giving them free will I'm retired and I need my rent to live

The FED should sell it's MBS holdings off its balance sheet, then we'll see how "ethical capitalism" works out.

In order to bypass current rent control: Can't new builders build condominiums? Can't these condominiums be rented and considered single-family homes? Or could they build a large complex of townhomes (single family attached)?
