In my seaside village there was a piece of land on the cliff edge with some defunct public toilets on it. The council decided to sell it for building land but the several neighbours fought it saying there was a right of way across it. They used it for car parking as did everyone else. They put a petition in the church for locals to sign and confirm we had used it as a footpath. They won and bought the land between them. Then promptly fenced it off and turned the old toilets into an Airbandb!

It didn't work for planning when a property was split up into separate plots. Following the split there was a brief gap in a specific recreational use despite it being over 20 years beforehand. The new landowner of the bit where the recreational use occurred had to apply for planning for it to be lawful.

Wait. So "common law" means the law held common across the realm and not the law of the common people (as opposed to Laws passed by posh people)
