It is so stupid adverse possession is allowed in regards to property line. People can legally steal their neighbor's land and reduce their property value, legalized theft. Should be removed as a legal thing to do because states don't allow you to adversely possess their land, why should they allow people to take other's land? Properties are clearly denoted in the deed document and should be safe from encroachments.

Hypothetical situation. Let's say you have an adjacent neighbor who you think is surreptitiously trying to create pretext for adverse possession of part of your residential property in two years when their home will be old enough to claim adverse possession if they tack onto the prior owner in privity. Since buying your home four years ago and them moving in three years ago, you've seen them walking on your land, you've seen them bring a contractor onto your property but could not confront them at the time and now you have only two years left on the timeline to prevent adverse possession. You previously found something of theirs on your land and asked them to move it but they didn't so you moved it to their side (a pole mounted birdhouse let's say). You offered them a permission letter to leave the birdhouse in place and they declined so you then moved it to their side where it still sits. You've had two surveys since moving in four years ago and both corroborated the iron pipes and other adjoining survey corners as per county records. What else can you do to make adverse possession of your property they seem to want very hard for them in two years? There is nothing to grant them permission for now as they have not been seen on your property in a while, their birdhouse is removed and you don't want them on your land anyway. What would be a good strategy for this scenario as the clock is Any actions that can or should be taken? Any strategies to consider?

Hello JD, Missouri land owner here. I’ve recently had a county commissioner authorize his people to maliciously trespass in a neighboring county where he has no authority. Without permission. Tearing down my gate ripping poles out of the ground and desecrate my property. Crossing county lines without any authority to do so. Because he believes he is above the law. My property is posted no trespassing and painted purple to indicate this. With admission of guilt from his county workers as they were directed by him to trespass. We contacted sheriffs and pressed charges to only be put under the table. Prosecutor was not going to persue this case citing it was a civil matter. Trying to find a lawyer to hear this case has been challenging. Everyone knows everybody. These people opened me up to a huge liability by tearing down my gate. Someone could have easily been hurt or stolen thousands in property. Now feeling insecure and overwhelmed with this burden has left me extremely angry and worried that it could happen again. My property is surrounded by mark train forest and has only one entrance. The county has refused to maintain this road leading up to the property and the forests has not taken care of there portion either. Someone wants access through my property and by not allowing this continued harassment and neglect of road, enough is enough. Four years of this I want to make sure this happens to know one else. Illegal trespassing and distruction of private property by a public official. Would you have any advice as to seek a competent attorney to open up a lawsuit on behalf of the property owner. We have sent out a demand letter with representation of a attorney but do not expect a response. As this case was being brushed under the table. My civil rights were violated and need help. Thank you and of course there are many details yet to be included. Any advice?

A licensed surveyor and a permission letter sent by Registered Mail, receipt requested worked in my case. My neighbor had purchased the adjacent property without obtaining a survey from the prior owners who had thrown up fencing (also without a survey). The survey was key since the fencing had only been built 2-4 years prior the sale of the house.

I live in a rural area of Mississippi. My spouse’s parents divided their 120 acres between three children. My wife acquired 40 acres while I was serving in the Army. Upon retiring from 21 years of service we moved onto the property and built a house. That mandated that a certain amount of land be surveyed for the benefit of the mortgage company.


Sometime later my neighbor erected a barbed wire fence that encroached onto our land, including the home property. I brought this up with the landowner who did not live on his property. That property was simply used for deer hunting – no house, barn, or other structures. The owner’s son told me they owned the property due to adverse possession. I later moved the fence onto the legal property line and they returned it to its original position.

This all started because my father-in-law had a culvert on the road right-of-way so he could drive into his property. All those years ago there were few fences along that rural road. He allowed his neighbor to use that driveway entrance, also. It simply saved him from emplacing his own driveway culvert. While I was in the Army the neighbor put up a gate and the fence.

Does this sound as if he meets the criteria to legally steal my property?

Hello and Thank you sir for this great informative video. I live in Missouri Southern Jefferson County and am in a situation with are scarce and odd neighbor that may be a Vampire lol! Anyways we used to own the land he now owns which is actually adjacent to our house and land. It is a 2 Acre hole. I mean from the road and his property drops off straight down like a cliff. Basically the only access he has to the property is a small grass road which is non existent anymore now that he decided to cut down a tree and just leave it and create his own Amazon Rainforest. Now the property connects to are land with a hill and steps along with an actual driveable road to access. It is literally right next to are house. We cut the grass and try to keep it up to make it look decent, maintained, grass cut, removed a rotten tree, has are sched still there and also so that a Bear or an Anaconda doesn't come out and surprise the kids and of course so people don't think we are the Munsters. Now halfway over through the property is own Amazon I was talking about earlier. The difference is NIGHT AND DAY because his side of the property looks like The Munsters back yard 'LITERALLY"!! Now about halfway over through the property about 15 Feet over one could start to film the new episode of National Geographic Rainforest Habitat. Any ideas? Is it worth it? I have photos of what it looks like now and back then 10+ years ago. Thank you!!

What if you bought the property and the fenced property was there 10 years before you bought but not 10 years since you have bought it

I have a warranty deed and have been here 20 years, neighbor died, his son gets a new survey and demands I dig up my septic system, he shears off an acre with electronic survey verses mets and bounds survey from 1952, I may need this adverse possession since he says his new deed over rides original

My neighbor bought the house next to mine and built a fence flush on my side of the property line. I bought half the fence for 800 dollars. A lawyer told me the bid quote with his signature was more than enough to keep the new owners from fully claiming the fence.

Can a person get property that is right next to your home and the acquisition prevents you from repairing your home? Like literally a foot from your house?

I bought my one acre property which is connected to my neighbors at the back. I bought my property back in 2010 and was told that the back fence that is shared by both parties is approximately 4 feet inside my property line. The people that bought the house behind me that share the said fence bought their property about 5 years ago. I have made it known to the more than once that they need to move their fence back when they first took possession of the home. Yesterday I again had the same conversation about the fence, the conversation went no where. The fence does not go all the way across the back of property so I do have access to a small section. Every one around me knows that the fence is on my property and also knows that I have said that I need it moved. I own the property free and clear the only part that is mortgaged I’d the double wide home. I have paid taxes on the property for the full almost 13 years that I have owned it. I have also resided on the land since 2012.
