The easiest way to tell if the documents are currently unclassified is to file a FOIA request for them and see what comes back. In any event, these documents belong to the United States and not to Trump, and it is unlawful for him to possess and conceal them.

Honig said there isn't a 'thing' in place about declassifying documents, and he's not quite correct there. There actually is a procedure in place for declassifying documents. First, classified docs are stamped 'CLASSIFIED' on the top and bottom of each doc, usually with a date, a level of Classification and who classified. When a document is declassified, there are staffers that immediately take that document and use special stamps to cross out the original 'CLASSIFED' stamp and replace it with a 'DECLASSIFIED' stamp. The new stamp states the date of the declassification and who ordered it, as well as any other information relevant. This is a BIG deal regarding declassification. Yes, the president can declassify anything he wants, and he can do it in any manner he wants, verbally or written. BUT, the important thing is that the document IS altered to reflect the new status, and it's done immediately. Trump couldn't just say he declassified something, and then went around showing it to people without the document being marked up as declassified.
