If a soldier disguises themselves by wearing the uniform of the enemy or civilian clothing, it is considered perfidy, The use of perfidy is strictly prohibited by the laws of war as it undermines the fundamental principle of distinguishing between combatants-and-non combatants. The Geneva conventions actually specified that overcoats without insignia are not classed as a identifying uniform article. Meaning if a soldier exactly like the one depicted was simply wearing the coat but kept his Helmet web gear and actual uniform on underneath he is not committing perfidy. Brad Pitt committed a war crime.
(Edit; I understand Brad Pitt wasn't actually committing a war crime. I just didn't know his characters name for fucks sake)

Here's a fun fact, Perfidy was added to the Geneva Convention in 1977 which means it wouldn't have been in effect during WW2

Under the laws of war this is a war crime. The soldier in question scavenged a coat for warmth. He was captured with other German PoWs and made no attempt to disguise his identity as a German soldier and was not under taking any espionage acts. He was still wearing his German helmet, carrying a German weapons, and other German equipment.

There were no legal grounds here to execute the soldier in this situation.

The German soldier was not committing any war crime as he was just wearing an overcoat whilst maintaining the rest of his uniform including the identifying stahl helm. No war crime committed by the German.

The funnt part about people talking about WWII and the Geneva Convention is that the differentiation of Civilians, Medical Personnel, and Combatants was only signed in AFTER WWII.

yes, in the comfort of one's living room, on a computer, this is true. In 1945 germany, supplies to most frontline units had long since been exhausted, and the took what they had to to survive. I've heard stories from WWII vets saying they captured whole units of germans in US uniforms, but with german helmets, rank badges, and equipment (much of it fell into their hands in the Battle of the Bulge). They weren't tryna be spies, they were tryna keep warm.

Perfidy also includes an intent to deceive, not survive harsh environmental conditions. You can wear an enemy coat to keep warm. You cannot put on an enemy dress uniform and attempt to infiltrate enemy lines. That's the difference. It was pretty common to pick up any garment that wasn't full of holes or filth to keep warm, doesn't matter if it's civilian, friendly, enemy, a coat is a coat when it's -20°.

Overcoats are an exception. They committed a war crime. The soldier has his full uniform on, under the overcoat.

He is also clearly wearing his stahlhelm helmet, which would immediately mark him as German. No one would blame a soldier for keeping warm, they'd just hate that he clearly took it from a fallen comrade.

There were American soldiers in this scene that were in full German kit. Coat, webbing and helmets. They were actually violating war crimes.

The German soldier was not, he only had a coat and was not trying to disguise himself.


That was the entire point of the scene. It was depicting that the allies could be just as blood thirsty as anyone else, the coat was just an excuse.
