Disability attorneys Gregory Dell and Cesar Gavidia discuss Rheumatoid Arthritis and claims for short and long term disability benefits involving this condition.

Rheumatoid Arthritis (RA) is an inflammatory autoimmune disease. RA can be diagnosed using a variety of methods, such as x-rays, physical exam findings, and blood tests that can be performed which reveal if a person has a certain RA factor. However, recent clinical studies have shown that 50% of people who suffer from RA, do not have positive blood tests.

Disability insurance companies often use negative blood tests as a means to demonstrate that a claimant is not suffering from RA and, therefore, is able to function and perform their job. Additionally, disability insurance companies also try to find a lack of information in the medical records as a means to deny claims, such as, the claimant is not receiving ultra aggressive treatments for RA so that must mean they do not have any work restrictions or limitations. Often, claimants will suffer from "flares" related to RA, and will have good days and bad days.

It is important for claimants to be sure that their physicians are properly documenting the symptoms caused by RA which prevent they claimant from functioning in the workplace.

Recently diagnosed. Some days very little pain. Some days I can be at rest on the couch & experiencing real pain inwrists & shoulders especially but hips and knees as well. Mtg with a rheumatologist in 2 weeks & pretty worried about what meds I will now have to take. I hear some of them are quite powerful. Worrying about quality of life from here on at age 57.

I suffer from RA and Remicade ended up adding to my list of problems. My heart and lungs have been affected. I've been hospitalized and have gone through a long list of DMARDS including Methotrexate, which is like a mild form of chemo. I'm about 10 years into the disease and going through surgeries, infusions, daily meds and my life fell apart because of RA. I contacted a disability attorney. Now waiting to see what happens. The disease is far more than just joint pain. I now have a lung disease due to RA. It's affected my life on all levels; physically, mentally, emotionally and even spiritually. My understanding of the social security disability process is that it's a long process and most of us will get denied, but I'm putting it in God's hands. It's a horrible and debilitating disease that I wouldn't wish anyone else to suffer through. It's especially hard being so young. I think at least talking to an attorney and finding out what your options are is a good idea.

What if you have applied once and been denied? I am 100% disabled and they threw my claim out like it was nothing.

So what do you have to be confined to a wheelchair or confined to a bed in order to get disability?

Every good lawyer knows that the social security disability system is inhumane and cruel. All they want to do is deny as many people as possible because they’re to lazy to research medical and work records quickly and efficiently
