I have a subject sociological thought and there is question about a Francis revolution. There I read about the Montesquieu how he contribute for sociology. In my subject they mention the book name " the spirit of the law", so I'm really glad to know about legendary person.

I got a hold of your paper on this. Very insightful and relevant to current events. I believe I know where your thoughts were when selecting the topic. Virtue and education are the bellwethers I've been watching very closely for most of my adult life. Unfortunately the swing to despotism is an increasing likelihood given increasing secularization and infiltration of postmodern ideology in our educational institutions. I believe we've reached a point where a certain level of secession will be necessary to restore our republic.

For more info, I suggest Polybius and Cicero who wrote about the checks and balances of the Roman Republic. The major difference is that the judicial system was tied into both the magistrates, senate and assemblies. But the magistrates (representing monarchy), the senate (aristocraticy) and the assemblies (democracy) were themselves on separate but equal standing. This is where this idea sort of originates (though more really with Aristotle).

Further the founding of the American institutions reflected a similar approach.

House of Representatives = representative democracy

Senate = aristocraticy (note these were chosen by the state legislatures until the 17th amendment in the early 20th century)

President and VP = monarchy (note popular elections for the states choice of EC was not leveraged in every state)

Also worth noting, according to Aristotle, voting in an election of a candidate was seen as more aristocratic than democratic (to be clear I'm using the actual definition as the Greeks did, meaning the rule of the best). More democratic elements were things like being chosen by lot and never serving again as each citizen was thought to eventually hold their turn in office.

Thanks for this one, this was a very good and concice analysis of all that Montesquieu gave us, he was a great philosopher and should still be recognized as such. Now we are loosing it to all kinds of despotic mob bosses and the ones governing with even more random forms terrorism. This starts to look like a Bakunian world. Therefire, we should definitely start educating kids with the Troglodytes!

The reality shows that the separation of powers, or any other devices promoted by Montesquieu, has failed miserably in all parts of the world. The model promoted by Monty relies on the negative side of human nature, which is jealousy. In human society, negative energy simply cannot generate positive results. The result we can see today is nothing less than tragic; one level of checks and balances requires another level of checks and balances and so on and so forth, to infinity. (Just trying to apply checks and balances to the FBI today. Good luck.)
Put simply, you will not have a healthy and happy society by putting two Mafia Families in power to achieve checks and balances.
The Spirit of Law should be rebranded as The Law without Spirit.
I have to say your presentation is great and very professional.
