Experience of a Banker (IDBI) in UP- Atiq Ahmed, a notorious mafia don has been shot dead in UP. It was a very fascinating news for me. I heard Atiq’s name for the first time in 2005 when we were planning to auction the assets of Rajinder Steels Ltd., one of 634 cases in SASF portfolio. Atiq was an M.P. of Samajwadi Party and was in jail at that time for some serious criminal activity. He came out on parole during the auction time, perhaps only to “participate” in the auction. Rajinder Steels Ltd was in liquidation and in possession of Official Liquidator of Allahabad High Court. The auction was to take place in Allahabad. SASF was represented by our colleague Mr A.K. Mishra. There was good interest in the assets and 11 bidders, (a few of them very reputed) participated with sealed bids. At the scheduled time of auction, Atiq Ahmed along with 15 of his aides armed with AK 47 guns forced themselves in and proceedings were taken over by Atiq. He asked the bidders to open the sealed covers and forced them to correct their bid amounts as dictated by him. No bidder was allowed to withdraw or move out of Allahabad before conclusion of the auction. Mr Mishra gave me a ring and told me that things are not going well in the Auction.
Mr Mishra before leaving Allahabad explained to me what happened at the Auction site. I also got a call from one of the bidders who explained the same thing that Mr Mishra narrated. He additionally informed me that Atiq had summoned all the bidders to meet him at a hotel in the evening, with a strict warning that nobody will leave Allahabad before the meeting.
On our side, we were wondering what to do. As per the advise of Harish Chander, we sent a Fax to Hon. Judge Mr Ambavani of Allahabad High Court requesting him to cancel the Bids and to allow SASF to hold the auction anywhere in India except in Uttar Pradesh. Harish was very confident about the uprightness and honesty of this Judge.
The process of bidding directed by Atiq was narrated to me by a bidder, (CMD of a large Steel company). All the 11 bidders were present at the specified hotel and Atiq told the bidders that one steel company (as decided by him) will finally bid for an amount of Rs 23 cr and nobody will bid above that. The said company will have to pay Rs 16 crore to him out of which Rs 8 crore or 50% will go to himself and Rs 8 crore will be divided equally among the bidders.
It was a pleasant surprise for us in SASF when we received a message from Allahabad High Court the very next day that Rajinder Steel bid has been cancelled and that SASF was free to hold the auction anywhere in India. The Judge also ordered for a CBI enquiry into the issue. Mr Mishra and Harish Chander had to appear before CBI even in 2018-19 in this case. As I learn from Harish and Mishra, Justice Ambawani was monitoring the CBI case and it is pending for decision.
The auction of the assets was held in IDBI Tower and the assets were sold to Jayswal NECO Ltd at around Rs 75 crore.
It is nice to learn that UP is a much better place for investment now and that CM Yogi has done good by putting goondas in jail or eliminating them. Thought of sharing this interesting experience when I saw the news about the death of Atiq. There was threat on our lives, but the grit and courage shown by Mishra and Harish Chander who were my Legal stalwarts at that time was exemplary.
