The Trap That Could Unravel the Entire NFA

We always thought that the easiest, and therefor most likely successful challenge to the NFA would be suppressors. But think again. Washington Gun Law President, William Kirk, discusses the matter of United States v. Robinson, a challenge to the constitutionality of the NFA's inclusion of short barrel rifles. And yes, the ATF's attempt to classify all pistols with attached stabilizing braces as SBRs comes back to bite them. In fact, DOJ has really painted themselves into a corner here, giving this case a real chance. So learn more today and arm yourself with education.

If a SBR is a "dangerous weapon" but you can pay the govt $200 and it becomes un-dangerous, it was never dangerous in the first place.

We should mention every time the NFA is brought up that the politicians knew it was likely unconstitutional and that they acknowledge none of these weapons can be banned due to the 2a. So the best they could do was tax it to death....which is also unconstitutional.

And it's only taken nearly one hundred years to begin to expose the NFA as unconstitutional.

Did I hear that right? These arguments are being made by a public defender? Best public defender in history.

Shotguns with cut off shortened barrels were used to defend stage coaches for years!

SBRs are DEFINITELY the lowest of low hanging fruit. The idea that a gun becomes some sort of deadly, snake-like evil weapon with certain barrel lengths is one of the most ABSURD fantasies humans have ever come up with. Barrel lengths are varied in order to TUNE a rifle to the purpose it's needed for: longer barrels for longer ranges, shorter barrels for shorter fighting ranges.

Not One Thing about the NFA was EVER CONSTITUTIONAL, Ever!!!

Breaching shotguns, a short barreled shotgun is also in common military and police use.

A tax on a constitutional right is unfathomable.

5:05 Let’s not forget the Thompson .45 whose barrel length was between 10.52 and 12 inches, which was issued during WW2, and used in Korea and Vietnam.

I was always under the impression that a constitutional right CANNOT be taxed!

One would also have to consider when the government released for sale a huge number of .30 cal carbines as war surplus to the general public. They later determined that the barrel length was too short for the NFA and had to change the NFA barrel length to allow those carbines to remain in public hands.

It will get to a point where we will be able to purchase suppressors and sbr's over the counter, same day BUT WE MUST STOP GIVING THE GOVERNMENT OUR PERMISSION FIRST.

Govt. says " you are not allowed to own this item, unless you give us money." Sounds kinda like a protection racket. Or maybe even a RICO charge, against our own govt. These are interesting times.

I'm impressed that court appointed lawyers are handling this case so well! Kudos!

I've been telling everyone this for years. The purpose of the 2A, is to ensure the right to keep and bear arms used by the standing army. Long ago it was the 1903 Springfield, then the M1 Garand, the M-14, and M-16. Now, it is the M4, which is a short barreled rifle. If a call to arms is made, the citizenry must have the ability to be armed in similar fashion to the standing army in order to function as needed in combat.

This is exactly the argument that I have been saying we need to use; the ATF says that pistol braces make an unregistered SBR, and there are tens of millions in common use, as well as the standard issue weapon for the US Army being an SBR, both of which shows that they are neither particularly dangerous or unusual.

Wow. That's such an interesting argument. Also Miller seems to support the citizens owning machine guns as well.

I've been waiting for someone to not only get this opportunity but to also run with the fact that our military does issue short barreled rifles along with suppressors being common military and police use also
