Well, this will in no way be controversial. But this legal issue was bound to come up someday. It is black history month though ...

Under both federal law and Washington state law, minority owned businesses can receive preference for certain government contracts.

Enter Ralph Taylor, a Washington State resident, who owns Orion Insurance Company. Mr. Taylor grew up identifying as Caucasian, and according to the court at least, visually would appear to be Caucasian (take note, a court is literally judging someone based, in part, on the color of their skin. Super.)

In today's legal analysis, a court has to decide when someone is black enough to call themselves black.

A tribal counsel would have been the group to give him a letter of membership and activity, had he actually been active with them. I think that was what the letter he was asked to obtain is. As for "who is" ? I'd say, 1 parent out of 8 is if they want to use it against you, and 2 out of 8 if you want to gain from it.

My god kids are a quarter Hispanic and one looks totally Hispanic and one totally white. They actually took after each parent. It's awesome :) kinda like the twins who one is black and one white who were born to mixed parents. Their grandparents are also mixed on both sides which allows this amazing genetic phenomenon to have a chance to occur... At least that is what I understood from reading about them.

I am black, white and native american often classify myself as of mixed nationalities. People have taken it upon themselves to classified me when I chose not to answer that question! But in this instance, Mr Taylor is full of crap and in my opinion he is black and native American only as a matter of convenience -- called money!!! The court saw thru his veil attempt to cash in on his DNA test. If he had not done the DNA test he would have still considered himself and checked that box as being white. Birth certificates, and census and are easy to use to prove ethnicity and even certifications are easy to obtain upon doing ones family history and documenting it when it is true!

Perhaps we should all watch the 1949 Movie: Pinky as reference to see how pale African Americans who could "pass as white" faired in the old South. Those old distinctions are now almost irrelevant in today's homogeneous society.
