1. The right to seek bail is rooted in the fundamental rights to personal liberty and protection from arbitrary detention. When the court grants you bail, it doesn't prove your innocence. Therefore, making the statement "If I have done that, how am I out on bail" is absolutely wrong.

2. A judge grants an accused bail based on the bond amount and certain conditions; this doesn't mean you have received a verdict.

3. Section 41 of the CrPC allows the police to arrest a person without a warrant under certain conditions, such as if the person is involved in a cognizable offense.

4. As I assume, the chargesheet hasn't been filed in court, and only a bail plea was filed on Rajat Dalal's behalf. In that matter, why would the victim need to be present? The victim needs to be present when the court requires it. Since it is a criminal proceeding, it will be Rajat Dalal vs State of Gujarat.

5. Regarding evidence, it's the police's job to conduct medical tests and gather evidence. They are bound to present it to the court and your lawyer before the hearing.

6. If that guy was making social media posts against you, you had the right to file a defamation case against him. You could have pursued criminal or civil action, but who gave you the authority to take the law into your own hands?

7. As of now, I don't think the proceedings have started in the court of justice. Hence, why would the victim need to prove their points?

This guy Rajat Dalal is ignorant of the facts. I recommend he seek guidance from an experienced lawyer before going Instagram Live with half-baked knowledge.
