I feel like Cardano might be able to avoid the regulation because when it comes to staking the pools don’t actually have custody of your ADA. It takes a snapshot of the wallet balance so your ADA never actually leaver your wallet. Other projects require you to relinquish custody of your assets and at that point it could be classified as a security
