The Magistrate had now asked the drawer of the check to pay the money in just 2 months. Unfortunately, the donor of the check died before the time given to pay the money. What to do ?

N I 138 case is in trial before session court since 2014,
Now accused died 2021 .
Can I file civil recovery or any other kind of suit against his son/wife ?
One Advocate suggested I can file,
Other Advocate said time limit is 3 yrs only for civil suit.

Sir, What step to take if accused absconding in Cheque bounce case. In my case the accused initially pleaded in court and for last 5 hearings the accused is not responding and warrant by court is not working because police say accused is not present in address and I have also verified that he is not present in address. Please help. The accused is active on social media. I know his home and he is not there at home but his few family members are there who are saying that they don't know accused.
