Hi Guys!
GST is applicable only on a sale of an under-construction property. GST of 1% and 5% (without itc) is applicable on affordable housing and normal housing respectively.

Please note GST set off is not applicable on an immovable property! This means that even buyers buying such properties on their company name having a legitimate GST number, CANNOT set it off as input credit in their books!

For eg: For an under construction residential property worth ₹50 Lakhs, GST @5% will be ₹2.50 Lakhs. Don’t think that even if you have bought this flat in your company’s name with a legitimate company GST number you’ll be able to claim the ₹2.50 Lakhs back from the Govt as input credit against your company’s expenditure bills!

without GST they wont sell any flat to so you wont have house in branded apartment

I paid gst on under construction flat and if the builder does not pay the amount to the government will it be a problem for me in the future and should I demand the gst receipts

Sir mai ek under construction property buy kar raha hu, mujhe builder 5% GST alag se paid paid karne ko bol raha hai.
Mere pas GST no. Nahi hai, kay mujhe Input Tax Credit ka Fayda mil sakta hai kya
