Even if you’ve been arrested, law enforcement personnel can take your phone, but still need a warrant to access what is on the device.
U.S. border protection agents, including at airports, typically have more legal leeway to search your phone.

That's like saying it's legal for a cop to open your fingerprint safe by dragging your hand to the scanner. I swear, the biggest problem with tech legislation is that lawmakers cannot wrap their heads around how to integrate even 20 year old technology into the body of law on search and seizure

If they were after a physical photo, physical correspondence, print outs of every website you visti, they would need a warrant. I dont see how it being digital makes any difference.

If you do insist on using FaceID or fingerprint ID, if you’re about to interact with the police, you can hold the power button and a volume button for one second and it’ll lock your phone and disable biometrics, at which point you’ll need to enter your PIN to unlock it.

One point, the officer would not ask "can I see your phone", they would say "do you mind me looking at your phone". They love these leading and confusing questions...

The fact that your phone can be searched with out a warrant if you use biometrics is a complete joke, the whole point of biometrics is that only you can unlock it. A police officer taking your phone and putting it up to your face, even if you are unconscious, to get in is not different than picking a lock.

Good to see a decently sized source make this point. I was reading about some random article about a case last year and in the process looked up the legal precedent. I havent had my fingerprint on my phone since, just a number passcode, and i regularly encourage people to do the same.
