Don't the Senate have ground rules when conducting hearings? For example, ...

1. State the purpose of the hearing.
2. Be mindful of and explicitly agree on the ground rules.
3. Show up on time and come prepared.
4. Stay on point.
5. Use people's (taxpayer's) resources wisely.
6. Treat people with respect.
7. Seek first to understand, not to be understood.
8. Take turns speaking. Do not interrupt when someone is talking.
9. Listen with an open mind. No one-on-one side hearing.
10. Stay mentally and physically present.
11. Close decisions and follow up.
12. Record outcomes and share all relevant information.
13. End on time.

What questions to ask in order to get the information you need:

1. Know your purpose.
2. Do your research. Do not assume things. Have a curious mindset.
3. Use open-ended questions. (what, how, why)
4. Ask probing questions. (who, where, when)
5. Avoid leading or loaded questions. Keep your questions short.
6. Use the appropriate tone.
7. Be a good listener.
8. Go where the conversation takes you.
9. Use silence to your advantage. Pausing to listen between answers gives you time to think about what was said and ask better follow-up questions.
10. Use clarifying and confirming questions. Paraphrase what you heard using your own words.
11. Use scaling or ranking questions (Scale/rank question type can be used to ask respondents whether they agree or disagree with a number of statements, to rate items on a scale, or to rank items in order of importance or preference)
12. Get your sequence right.

What questions to avoid:

1. Avoid leading questions. A leading question already assumes an answer. People who ask leading questions typically want to confirm what they already know. It doesn’t leave room for different responses or new information.

The power of questions is learning something new from the answer. Try not to lead someone to a specific answer if their opinion could be valuable. Keep your question clear, simple, and, when you can, uninfluenced by bias.

2. Don’t ignore clear signals. Learning to ask good questions requires reading the room and picking up on verbal and nonverbal cues the responder is sending us. Answering questions isn’t always easy, and that might show.

Pay attention to the person’s body language. Is their body pointed toward you or are they turned away? Do they maintain eye contact or avoid looking at you? Are their tone, speed, and volume suggesting they feel comfortable or distressed?

If the other person is showing that they’re uncomfortable, respect their space — you’re likely not getting great or honest answers, anyway. Making the person uncomfortable won’t build trust or help you learn the information you need.

3. Don’t ask “Yes” or “No” questions. Closed-off questions that only require a “Yes” or “No” answers are great for confirming information, not eliciting new and relevant information.
