How do I take legal action against a doctor? Do you sue the doctor or hospital?
Hello and welcome! My name is Mehdi Cherkaoui. I'm an attorney in Houston Texas. In this video I’m going to give you some tips on how to sue a doctor or hospital for negligence.
In a hospital, your medical care can go wrong. Instead of getting well, you may incur injury as a result of a doctor's neglect. If this happens, you may have grounds to sue the hospital for medical negligence.
Medical malpractice happens when practitioners or health care professionals violate their legal obligation to care for patients. Persons working in the medical industry are required by law to have adequate knowledge and skills in order to provide appropriate care to patients.
If a hospital provides you with the incorrect treatment, their personnel makes the incorrect decision or a loved one dies while in their care, you may be able to sue. Although medical staff may have committed the error, the institution is liable for its workers and their training.
Every state has its own statute of limitations (a time restriction within which you may initiate a lawsuit). If you intend to sue the hospital, you should first investigate your state's unique limits. This video will discuss medical malpractice and how patients might take action. My mothers oxygen monitor was turned off by a nurse. It was doctors orders to keep it on. Anyways after the oxygen was no longer monitored she went into cardiac arrest and had severe brain damage. She was on life support for a week after doing egg scan and ct scan she was declared brain dead. We took her off life support yesterday and she passed quickly. There was also so much more done to her at this hospital. But that a little piece towards the end. My dad and i want to file a lawsuit against this hospital. We want an apology and the person who did that to her to be fired.

Seems like it would be damn near impossible to hold a psychiatrist accountable for gross negligence, let alone false imprisonment of a "voluntary" inpatient that was duped into entering a room they were told was the waiting area for a behavioral health urgent care clinic where they could obtain a partial prescription to tide them over to their upcoming appointment, LOCKED IN, and subsequently goaded under duress into signing what turned out to be admission papers, and then held involuntarily a week beyond 96hours WITHOUT a court order, and denied access to their phone to retrieve the numbers of anyone that could help them.

I was in a bicycle accident and was taken to hospital by ambulance. They did x-rays and CT scans on head. Final conclusion was that 'Nothing is broken, dislocated, or fractured. Next day (few hours later) i noticed my collar bone had a strange dent or void compared to my opposite side. It was hard to breath, muscles were pulling to reposition and obviously I am severely bruised. I went to an ER facility ran by the same company but closer to home.

Told them my situation ansd how something was very wrong and that I believed I something was very wrong and not as they claimed. The Doctor says, " I can take a look at the X-rays, or do an MRI to look for tendon/ligament tears or for a possible dislocation which can occur due to extreme spasms where the body is trying to hold everything into place. However, I was sent away, with a muscle relaxer prescription, no MRI, no follow-up X-ray, and she even said I can take the sling off and that it wasnt needed. My medical record was updated that they took x-rays a second time and the rest was basically copy and paste.

I cannpt rehabilitate myself if I dont know what the fck is wrong. You cant just go pullimg, stretching, and excercising without knowing the risk. After two nights the symptoms have worsened. I did everything i can to be careful and rest as everything got worse. After noticing somethings were getting better, the same area was getting worse. Neck and shoulder muscles were pulling so hard that to swallow made my whole neck hurt. Then finally I felt a lovely pop and now the pain is more severe than it had been since the accident. My neck feels like something that was there going to the collar bone is now gone. I instantly lost 60% of motion. I'm guessing this is totally ok on their part. I hope my family will find a way without me being able to work. The one thing I wanted was truthful disclosure to prevent this from getting worse.

It’s crazy when you think about how these doctors make medical malpractice mistakes, eventually retire with a pension that is as much as the value of your Texas malpractice claims. I hope I never see any bad medical doctors in Las Vegas.

LOL I find it fascinating that this guy focus is on money first and how difficult it is to sue because there’s a cap on how much people can get in damages. The fact of the matter is a little bit of money is better than nothing and if it goes against the doctors license the better. it is for future patients as well as current ones. The biggest problem is because there’s a cap on lawsuit awards many attorneys are reluctant to take cases. It’s sad because most attorneys are all about the money that’s called GREED. So hard to find an attorney who will fight for you because you’ve been damaged by somebody who had the schooling and is who is governed by rules and regulations and should be sued.
If you’ve been damaged by a hospital or a physician and you can’t find an attorney because nobody will take your case even if you have a good one please consider filing a grievance with the states medical board and your insurance.
People don’t not want to hear what you can’t do for them people wanna hear what you can do for them to refuse case after case after case is a benefit for the medical community full of bad doctors!!
Hell just listen to the podcast Dr. death it was no attorney that helped out those patients it was another physician!!

My mother went into the hospital on February the 20th she had a UTI, While there her afeb went to acting and up. They performed what is called a TEE. 20 minutes later when my mother came back to her room, she was different. She talked and spoke like she had a trait. I asked the doctor what happened. And that she did not sound like that Before she went downstairs to that procedure. Doctor and nurse both told me she was fine she's just irritated because of the procedure and the tube that had to go down her throat.Doctor and nurse both told me she was fine that her throat was just irritated because of the procedure. From that point on my mother could not eat or drink anything. Then the doctor came back and said that she had what was called a diverticulum. Something that is formed on the throat to keep food from going down the right way and that this was the reason why she was choking on her food and water. Mind you this is not why she went into the hospital, mind you my mom ate fine and drunk fine prior to this procedure.So when I corresponded with a family friend who is a doctor he told me it sounds like they put a hole in her Asophicus when performing the TEE. Long story short my mom was in the hospital from February the 20th through March 7th and she passed on March 7th. My mom went most those days with no food or water mind you they kept saying that she had a diverticulum that was causing this. they never thought that I would go and get a autopsy done. As of today we have buried my mother, and we did get an autopsy done. And it did show that mom not only did die from the hole in the esophagus but poison leaked out through her whole body and she never even had a diverticulum issue.🎉😢 By my mother already having a lot of other health issues and 75 years old on top of Ben black and on medicaid they probably never thought that I would go and get an autopsy They never once acknowledged what they did they knew what they did and covered the story up by trying to say that she had a diverticulum issue and that that was the thing that caused her to pass. Now that we have an optopsy done and her death certificate and a lawyer We will see them in court.😢😢😢😢😮 We Go in blind trusting a doctor in a hospital we go in blind having faith in believing that all their years of medical practice that they would do the right thing and that they will take care of our loved one to the best to their ability.
Doctors and hospitals alike take an oath to save a life not to take a life and then cover it up. My faith in hospitals and doctors have been altered for life😢😢😢

It's crazy that you have a short window on filling malpractice cases in nj compared to people who have been sexually assaulted. N OT FAIR AT ALL!

The 120 days rule makes no sense if the negligence of that doctor is only possible to become aware of after 120 days.

I had a double lung transplant 6 1/2 years ago at Baylor University in Dallas, Tx. I got sick and was takin to the hospital in Tyler, Tx. to wait for a room at Baylor. I'm taking anti-rejection medication and they decided not to give me my anti-rejection meds for 5 days . By the time I got to Dallas i was in critical condition and spent a week in ICU. I'm in Henderson Tx and could use your advice.

I’ve practically been ghosted by the hospital after my MRI been left with no results on my knee…. Now I’m worried if I’m left practically crippled because of this… I’ve tried calling them up to try chase it up with them but they just give me the old “I’ll have the doctor get back to you” every time…. And to behind with the doctor I let while in A&E tried to fob me off saying my X-ray was normal… when it wasn’t… and told me I was faking it

I was gouged in the eye by a patient at work. The injury blinded me. Required a cornea transplant five months after the injury. During the five months scarring in my injured eye developed. Now i experience double vision. I can see close to normal up to 12”. Beyond that the double vision worsens. The doctor apologized to me, explaining to me the double vision developed because they took too long to Perform the transplant procedure.

The ophthalmologist clinic kept postponing my procedure month after month. Their reason is, the hospital requires a number of the doctor’s patients (for the day) to perform my surgery. The waiting time for the doctor to gather other patients was a complete nightmare. The eye pressure I dealt with daily was unbearable.

The ophthalmologist and the hospital should know that waiting too long for a procedure of my nature will damage my vision. It’s clear neither cared. All a business to them.

So much more to explain, however, I have been legally represented by a worker’s compensation attorney.

I went private paid privately but all doctors in UK as re regulated. He put money first and instead of referring me for an MRI for further diagnosis since I had given him the ultrasound scan report and prescribed me pills which he suggested as a better option and kind of influenced me to take. Rather then surgery. He waisted my 7 months on this pills and the condition has gotten worse. He didn't even bother to get clarity on the situation to see how bad it was because he had no interest in performing a surgery. The issue seems like it got worse because he did further investigate and he just wouldn't refer me for an MRI when I insisted via email. He wasn't responding. So I changed my doctor as ND am having surgery but it's got a bit complex because of his negligence, I wonder if that makes a good case

Thank you for this I now just found this video I was diagnosed with an infection and other painful things about a month ago and haven't been prescribed anything they have done nothing but ignore my calls and push appointments farther and farther away and I feel that's not ethical in the slightest specially seeings how infections can be deadly and move fast through the body..I will be sueing because I have gotten much worse since sep 27th and still no meds.

I was going to ask a question but apparently the maker of the video wants money for any advice. This country has an ethical problem that belongs to the big pharma and rich families. These Drs need to be held accountable for their despicable negligence but that would destroy the pyramid scheme that is all been being done to middle class and poor. I'm ashamed to be an American. 😢

I was abused in this mental hospital and weeks after i was discharged i still walk with a limp and my hip hurts. I was taking a shower and they pushed me out and punched my stomach and restrained me and denied me food and water.

Is it possible to sue a podiatrist in New Zealand for not following an appointment? They made us go on a two hour wasted trip after not informing us that their podiatrist is sick and making an excuse of putting down a wrong number. My father had to take a day off of work at the dairy farm and would have to do so again wasting not just his time but others as well.

when you talked about damages at 2:59. i think you got that incorrect. certain damages are capped, but there be many different types of tors added on top of that 250k that you mentioned, that limit was only refereing to damages itself, not the other torts like punitive damages which would be added on top of that.

most medical procedures or damages in these cases would be under 250k which sounds somewhat reasonable. and punitive damages is the thing that actually meant to punish them.

I'm screaming for help. I was only 23yrs old when I woke up sick. 4mths after my husband and I got married. I had a great job..I have 3 kids, 3 granddaughters. My dads family out of six kids, 3 youngest have passed. One having MSA. My dad has been sick about a yr and half longer than me. All he did was wake up. We were all very outdoorsy, could barely keep us inside. Campaign fishing sports.. I'm now 48 25yrs in Feb. My passion for life is so strong but my body so tired.. 90% bedridden, my dad 90%housebound. It's hars at times to keep going. I absolutely believe it's lyme and have proof. I was diagnosed with myalgic encephalomyelitis starting with a staph inf. I'm uncovering so much in my medical records where they could have saved me. Now this past July, my brother, 51 my only sibling found out he has myelofibrosis a rare blood disorder secondary to phenylephrine. I have a group page I started in 2015..ppl all over the world just like me!! Behind 4 walls! I'm also a suicide survivor. I have many testimonies throughout my life. God has me here for a reason. I'm here to spread a message if I'm healed or not. If I can stop any one person from such a tortuous, life snatching disease. ..that's what is so important. My life may be to far gone, I don't know. I was just a baby myself waking up in this body that is not mine. I'm in Indiana!
