Being a lawyer and having followed this case very closely, I have come to the inescapable conclusion that Judge Aileen Cannon's ruling is correct. Jack Smith's appointment as special counsel is unconstitutional and unlawful. Anyone interested should read 95 Notre Dame Law Review article (2019), "Why Robert Mueller's Appointment as Special Counsel was Unlawful". The issue is identical. Since the lapse of the Special Counsel statute in 1999, Attorney's General have not had the power to choose special counsel from the private sector. Merrick Garland had the power to choose a special counsel from among 93 U.S. attorneys, but chose an outsider, Jack Smith.
