The FTC’s new rule, which was meant to take effect on Sept. 4, is permanently on hold after a federal judge in Texas decided the government agency lacks the authority to put the ban in place.

So incredibly disappointing. With my current contractor, I am underpaid, no pto, no sick time, not paid for major holidays when the building I work at closes. I had another contractor already lined up for next month that offered a $4/hr raise, pto, sick time, major holidays paid. Now, because of 1 single judge in a state far away from me, I am back to being stuck in my current situation. Non-competes only benefit employers and allow them to treat their workers poorly. American workers deserve job freedom. We're told competition is a good thing, but this promotes the opposite. This is why I will never vote red. No matter what they say, they are anti working class and pro corporation.

I can't see how you will ever fix issues like this, as long as your politicians and other elected officials can be legally bribed with campaign donations and lobbying, there is almost zero countries in the developed world that allow their leaders to be legally bribed exactly because of these types of issues.
A lot of you guys have no idea how shitty your system is. I genuinely feel sorry for you all.

I've never signed a non-compete agreement. They never fired me, and 18 month later, I left that job and started my own junk removal businesses in florida.
I was working as a W2 employee, but the employer was paying me as 1099 independent contractor.
Today, I received a text message from this former employer saying that I violated the non-compete agreement and he is going to sue me if I don't close my new business.
While I was working for that company, I was making $180 a day. Most of the time, I worked from 9 to 14 hours a day without benefits and no overtime pay

Does anyone in here know if this becomes a legal issue or not?

The FTC does not have the authority to ban non compete clauses.

Well, fortunately . The only way an employer will know that I’m working for a competitor is if I tell them, post it on LinkedIn/social media, or if they know certain competitors or vendors. You can litterally strategically work with a competitor for higher pay if you what vendors the companies and ones they don’t. CEO has no idea what I do outside the business anyway lol



I’m all for rights for contracts just as long as it doesn’t restrict someone’s freedom in any way. In this case, freedom to earn a living anyway they wish.
