Analysis of the Telecom Bill 2022
A draft of the telecom bill was put in the public domain and the government invited comments from the public.
By this bill the government to consolidate and amend the existing laws governing the provision, development, expansion, and operation of services, networks, and infrastructure. India is one of the fastest-growing telecom markets and one of the top three markets in the world.
The government aims to replace three archaic laws, protect the customers and make a future-ready law to regulate this sector.
Ten sections make up the entire Telecom draft bill, 2022. It suggests that a new statute and a more straightforward regulatory structure are required. While the law highlights some of the crucial concerns that must be resolved in this reform, it glaringly leaves out some crucial details. We now live in the era of technologies such as 4G, 5G, the Internet of things, Industry 4.0, end-to-end communications, mobile edge computing etc. These technologies are creating new opportunities for India’s socio-economic growth. Therefore, India needs a legal framework attuned to the realities of the 21st Century.
This analysis looks at the impact fo this bill on the telecom sector, including the OTT sectors, on the ownership of Spectrum and other issues. It also looks at the compomise in privacy due to the new KYC provisions.
The government has wide powers in closing the internet services and in intercepting messages in the cause of public interest. These have not been adequately defined and gives unfettered powers to the government.
