Americans always had instruction in Bible history, geography and ethics until the early 1960's. Students learned the Golden Rule, the virtues and vices of kings in the Bible and how empires affected ancient Israel. In most of the country, the teaching didn't discuss church doctrine. Even James Madison, who wanted separation of church and state, read the New Testament at a public high school graduation. As far as court battles, the class could be called "Historic Public School Bible and Ethics Lessons" and how they affected American society. Then it could be argued to be of historical value. The students could debate how the teaching helped society and what was missing which made life worse.
