its important to note legacy of the duelist is not made by konami, its by a 3rd party developers
it seems like konami japan specifically are the ones who have this huge hate boner against air neos

GX not getting a dub for season 4 is because the dubs are time-staggered and by the time they reached season 4, 5D's was already into its airing and releasing English product. It just makes sense for the dubbing to move to 5D's, especially since season 4 of GX does not really advertise new product (mostly focusing on anime-original cards). Same reason is why 5D's didn't dub the final arc.

The name thing is completely implausible since it wouldn't explain the lack of reusing the card art on things like play mats, or Instant Contact.

The card art is also definitely not true for a similar reason - alt arts of cards get made for legal reasons many times (Mad Lobster, Fairy Tail Snow) and, again, Instant Contact would not have that issue. People who might claim "the design is from another trademarked character" but can't point to which character it might be.

The most likely reason in my opinion for Air Neos is just that due to a mistake in the legal stuff that its rights are held by TV Tokyo and it's not relevant enough of a card for Konami to go through the issue of transferring them over. If we assume TV Tokyo holds the rights to most of the stuff that goes to air by default, that is to say things like character design and music, so if Konami wants to use something in the anime they would need to either get the rights to it prior to it being held by TV Tokyo or go through some paperwork.
As mentioned, it was not in season 2 of the GX anime and the first time it DOES appear was in a duel with a lot of new monsters (all the Crystal Beasts). Some employee might have just assumed that since Neos was a season 2 card that it was already held by Konami. If it's that there was a mistake that made it so that TV Tokyo holds the legal right to the DESIGN of Air Neos, that explains why they can't just do an alt art and why it would be held out of Instant Contact.

This explanation would also cover why it's Legacy of the Duelist specifically that brought back Air Neos - a huge part of the game's marketing is recreation of anime-inspired duels and so Konami may have been in contact with stuff to get ahold of from TV Tokyo so they could just say, "We need Air Neos in some of these preconstructed deck lists, make sure you also get that."
Basically since Konami and TV Tokyo are on good terms it would mean Air Neos is never out of the ability for Konami to use, but it's more of a headache than necessary so they would opt to not bother most of the time.

Personally, I think it's just a joke. Somebody at Konami went "Hey wouldn't it be funny if we just never reprint this one Neos card ever again just to troll people" and they're kept the bit running ever since.

This genuinely feels like a Sora for Smash in the vote for Smash 4's Fighter Ballot situation, just that Konami doesn't care about Yugioh fans compared to how much effort Masahiro Sakurai had to put in to get Sora as the final DLC for Smash Ultimate.

And its a piece of cardboard. If Smash can get Sora, then there's GOTTA be something ridiculously wrong with Air Neos.

Air Neos died in a tragic accident during the filming of GX season 4, leading to the dub's cancellation. After his TCG reprint Air Hummingbird, who manages his estate, contacted Konami to ask that they avoid using his likeness in future products. They eventually negotiated an agreement allowing Konami to re-use old footage from when he worked for them, but denying any other applications. As such reprints of the original set he came from are allowed, even in other languages, and even the appearance in Legacy of the Duelist since its story mode is archival footage of the events of GX, but he's not available in Duel Links or Master Duel as they take place in the modern day and would necessitate new product. When all the Neos actors got back together again to recreate their classic pose from the old credits in Instant Contact, it was impossible to include Air as Hummingbird requested that Konami not sell any product featuring an Air Neos impersonator, so Konami was forced to add the impression of wings and call it a day. It really all makes sense if you think about it.

To be fair, the theory about the copyright issue with Neos Air is far from unlikely. Here's why: each of the italian translations of the Neos fusions are quite liteal and matching with the other translations (for example, Aqua Neos is "Neos Acqua", Grand Neos is "Grande Neos" and so on). Air Neos however is translated as "Neos Grandioso", which means "Great Neos" and has nothing to do with air, while a proper translation would have been "Neos Aria" or "Neos Aereo". The translations in all of the other languages were literal (Neos del Aire in Spanish, Néos Aérien in French and Air Neos in German). It wouldn't be the only time that Konami had tried to avoid copyright issues with other companies, that's why Fairy Tail Snow's outfit isn't blue outside of Japan. Of course they figured that out quickly since it involved Disney but with Neos Air, maybe they didn't think it would be a problem, even though, that might be the reason why they "mistranslated" Air Neos in Italian.

Air Neos was also available in the expanded version of Legacy of the Duelist, "Link Evolution", released in 2019 onwards. They surprisingly didn't remove it from that version (that game also includes all the Kazuki Takahashi art cards that MD/DL are similarly missing).

It also recently showed up in Duel Links' Chinese-only version a few months ago, not as an obtainable card from the shop etc, but usable in a limited-time PVP "Draft Mode" event exclusive to that version of the game. Will be interesting to see if it eventually is released as part of their own "Classic Server" for Duel Links since thats now into mid-GX era.

Air Neos actually is in Instant Contact. He is hiding behind Neos, Glow Neos, and Flare Neos. You can see some details sticking out, most notably the wings.

Read once someone speculating that the art/character design might have been plagiarized.
Would basically be a variant of the "artist owns the art", but not due to Konami's policy allowing it, just being legally claimed after it was already in circulation / in the anime.

Everyone wanted to see air neos, but Konami are probably waiting till they can change the errata so much that it'll be like a whole new card. Like Neo Air Neos or something.
