37:46 is so untrue. Intent is of central importance in everything from murder to assault to fraud to duty of care. The whole point of her question was to inquire into a criterion for assigning responsibility. 'At some point' doesn't really get anyone anywhere. Given that the legal system uses the concept of intention, his answer was almost entirely nonsense.

"District attorneys don't care if they put innocent people in jail". What wasn't mentioned is that there is an significant monetary and prestigious factor to this that I believe outshines the self deception factor by far in these kind of situations. It doesn't look very good in an attorneys CV to make mistakes like this. They lose credibility which could lead to problems in their career and income. It will also lead to huge damages for the state/district to pay the innocently convicted, why there also is a reason to suspect the legal system supports the prosecutors persistence to assert their position?! The West Memphis Three and the Alford Plea they more or less had to accept to be guaranteed freedom is just one of many examples of how the law system can avoid paying damages to the innocent and at the same time let the prosecutors and the whole system save their faces and reputation.

Odd that only believing in a god is religion. Nations and cultures are religious. Talk to soldiers willing to risk life for it's country or parent to child. It's called love! Those with no god are more likely to end self or another!
