[Question] "I'm a U.S. Citizen and I am pregnant but in another country. Will my baby
be able to have the U.S. Citizenship?"
It depends.
So the laws related to Citizenship through birth, or as a
child and you're born outside, are complex and they change over
time. But essentially, your type of case most likely, again,
you should consult with an Immigration attorney in private.
That's the appropriate thing to do about your case. But most
likely, as long as you live in the United States physically for
5 years and you can show it, and 2 or 3 of those
years are after the age of 14.
I can't remember the exact dates and time.
But that's 5 years, I think, 2 or 3 after the age of 14 minimum.
If you did that, your child, even if born overseas, automatically
acquires Citizenship at the time of birth. What you should
do is go to your local Embassy or Consulate, the U.S. Citizen
Services, and request a Consular Certificate of Birth
Abroad. Consular Registration of Birth Abroad.
CRBA - Consular Registration of Birth Abroad. I think that's
what a CRBA or something like that. You just do a search
on the Internet and
it'll come up. And that way, it's kind of like an additional
birth certificates, proof of their U.S. Citizenship. And you
also apply for their passport at the same time there, so that
they have it. Now, a really good thing to do once you have
that - it's a cheaper way to go, to do what I just said - get a passport,
the birth certificate, a Consular Birth Abroad Certificate,
You can look it up. But when you get to the United
States, you file Form
N-600. And Form N-600 is a Department of Homeland Security certification
that your child or that person is a U.S. Citizen.
It's very important to have, because out of like, say,
100,000 cases...
the State Department will issue passports to 100,000
people, the Department of Homeland Security which runs USCIS
Immigration Department, out of that 100,000,
they may not give to 5 of them.
They might not trust 5 of those and not get Citizenship.
So every once in a while, it's rare, but you'll find an Immigration
officer that won't accept the Citizenship and says
it's inappropriate.
So the sooner you file for the N-600, the better. It's kind
of expensive.
I think they're lowering the fee.
They're raising all the
fees, but I think for this one
they're lowering it. But I have to double-check. For the N-600,
you have to document the Physical Presence requirements, submit
that, and you get a Certificate of Citizenship.
It's really important for someone to have that. I would definitely
do that and have that with me.
But as you saw, there's a lot going on between the Embassy,
the Consular Record of Birth Abroad.
CRBA.
And then coming in for an N-600. Submit the proper paperwork.
That's why it's kind of important that you just go and consult with
an attorney in private to help you figure all that out, but
it is most likely possible.
But again, I don't know your situation.
I had a client who was born in the United States. As soon
as they were born, their parents took them outside the country
and never went back for 30 years. The person has had 4 kids by that
time. And they want to get passports for the children.
So, well, you never lived in the U.S. You didn't pass the Physical
Presence requirement.
You didn't live in the United States long enough.
So now we have to apply for Green Cards for your children.
And as soon as you enter the United States with those children,
the Green Cards - tada! - become Citizenship, as long as they
come before the age of 18.
I think it is.
It's complicated.
But so now we're in the process of getting them Green Cards to
come here. And once they're here, we're gonna apply for the
N-600, and also go to the local passport office to request
their passports. So you can get that. We can get that one quicker

But the Laws are what's just weird. My mom filed this for us when we were burned but my mom left the US at 15 before she was 16, they said that she can't pass down citizenship to me or my brother. That's Unfair

🤔 if the child acquired a us citizenship through one of the parents, there is no need for the N600… the Consular Report of Birth Abroad is sufficient. N600 is to derive Us citizenship. Big difference:
Consular Report: Acquire (Parent(s) already US citizens and also meets all of the requirements)
N600 : Derive ( After parent(s) became US Citizens…

Good morning sir I have 3 kids under 12 years old I’m US citizen and my kids overseas non US citizens I tried to apply for US citizens to my kids they You had children before you became a citizen of US you can apply only if your kids born after your US citizens

My sister had 2 kids in the US. Waited to get her daughter naturalized in Mexico because she had to get a passport from the US for Mexico to consider the application. By the time she was getting ready to do it the shut down happened. She had another baby . So she's just waited and I want her to come here to the US to visit me but neither of her kids have birth certificates. Just hospital records. Will they let them cross over with her passport and her kids hospital records ??

Hi: I am a US citiizen with a non-citizen wife. I have fulfilled the 5 yrs with 2 yrs after age 14. I spent 2 yrs studying my MBA in NY and working in NY for 2 yrs. So I have 4 yrs.
I was also born in the USA and stayed there until 9 yrs old, but I am having a hard time proving this as my elementary schools don't keep records for 30 yrs. Do you have any suggestions as what I can do to prove physical presence in US from birth to 9yrs old? THanks so much!

Would you be able to tell me which form should be used: N-600k or I-130 or both? The parent is a US citizen residing overseas, she moved overseas when she was 6 years old. The mother she has two children who were born overseas and she will like to get her children US citizenship.

Good evening sir.. so i got my n600 already, but i have siblings born overseas, way after my dad became a citizen but there birth was not reported at the time and at the moment we want to apply for usa passport for them but the requirements.. i need to provide their foreign birth certificate with the birth parents name on it, evidence of parent/s citizenship certificate, marriage certificate and a statement from your U.S. citizen parent(s) which lists where and when they lived in the U.S. and abroad before your birth, we have everything except the statement becomes my dad who's the us-citizen has pass away.. what should i do.. i have his previous and recent address with me

Hi! I'm a US citizen and I stayed in Ohio up until 7th grade middle school. My mother moved me to the Philippines. So, I've been in the US for a total of around 12 years but wasn't able to go back after I was 14 years old because my parents wanted me to go to school and university here.

I had a baby on Jan. 31, 2023.

I am a US Citizen and my spouse is a non US Citizen. I was born in 2000 and when I was 6years old my family and I shifted back to Pakistan. So I’ve lived in US for 6 years and in 2014 I visited USA for 1 month and in 2016 for 1 month or so. If I give birth in Pakistan, I don’t fulfil the requirement of being in the US after the age of 14 for two years. Can my baby be granted citizenship through my father? (grand parent) as he is a US national he has spent time in the US from 1998 till 2008 and he has possession in the US too (Apartments). What are the chances my child can get a US national?

Very informative, thank you! I'm abroad before the pandemic and now I'm stuck aborad due to the pandemic. I had my baby here, if I report the birth of my baby submit everything, how long will it take for my new born to get a passport? I physically lived in the states for more than 20 years and I have my W2's and transcripts. I've only been abroad for 3 years
