WOES OF OLD -PENSIONERS

Old-Pensioners of one grade/status are being discriminated against on the basis of meagre salary & Rigmarole of Rules at the time of their retirement. This basis is irrational, unjust, inhuman & irrelevant. A Divisional Commissioner of Lahore branded as an old- pensioner needs to be given the same respect & paid the same pension, if not more, as a recently retired commissioner (same grade). There is no compelling reason to insist on keeping discrimination between OLD & NEW pensioners ... There was NO rationale/need for it !
(1) Pensions are meant to ensure the standard-of-living of senior-citizens of a Grade / Status & save them from dependence on others in their lean period of life. The AGPR is duty-bound to function & facilitate matters within the FRAMEWORK !
(2) Welfare-Policy parameters given by the government and the decisions of the courts on one side, they keep adopting their own Policy of Objections & teasing activities on one or the other pretext undeterred for the reason of NO fear of reprisals & the reason not describable, they are adamant to give NO response !
(3) Fair play & dispensing justice is not their domain .
(4) It is no fun to resort to the nominated institution for justice (the COURTS) . To have fair dealings with the lawyers & expect decision within a reasonable time is hard to expect & the Cost here also is very formidable.
(5) The best & only convenient way left, then, to keep the mare going, ultimately, is MUK MAKA !
(6) In the interest of justice & to make things simple & easily understandable, it is suggested that a BENCHMARK may be prescribed that, on retirement all employees with 20 years total service & minimum three years in the last grade may be bracketed in the same MINIMUM PENSION of the last grade irrespective of the rigmarole of Formulas & Options made applicable from time to time.
The government policy is to ensure an improved standard of living & a respectable & easier life for its senior-citizens, at present, suffering from injustices due to the unnecessary complexities of rules & formulasthat have resulted only in promoting DISCRININATIONS
(7) It should be the duty of Anomalies-Committee of the Auditor-General of Pakistan to examine the disparities / discriminations after, at the most, every three years in the light of the government policy and the decisions of the courts, and improve / revise PENSIONS to undo any discrimination observed
(😎 Without REQUIRING the feeble aged persons to visit the AGPR or making applications to them for Commutation, Group-Insurance, Benevolent Fund etc. All benefits may be disbursed as a MATTER OF RIGHT through AGPR /DCS / BANKS & starting from The Senior-Most !
(9) Recovery-Notices from a pension may be totally BANNED & possibly WAVED, this is the cruellest joke with the court-decisions and defeats welfare-measures taken by the government. From the senior citizens, 30 years after pre-mature retirement (with 30 years’ service, 4 years in grade-19) AGPR Karachi has started recovering presumptive over-payment ... At the age of 82 years, not in my right senses, presently I am getting, after deductions, only Rs.45000/- per month a third of what I should be receiving... THIS UNFORTUNATE SITUATION SHOULD HAVE NOT COME INTO EXISTENCE !
(10) They are not inclined to reply to the Mercy Petitions ... THIS SINGLE-FACTOR IS RESPONSIBLE FOR PROMOTING 90% CORRUPTION & MUK-MUKA IN THE PUBLIC-DEALING DEPARTMENTS !
They are NOT prepared to realize and agree that pensions cannot be reduced even by courts ... & that too after 30 years !
Waiting for acknowledgement of RECEIPT of this memo & expecting all possible assistance for this JUST- CAUSE !

The Aged, the sick, the feeble & the tired PENSIONERS not in their right senses are the HUNTING GROUND of our fellow- brethren in the AGPR ... they would not let Pension Book be issued for FREE until a few years back ... It is only through the untiring SPECIAL CARE of the Present Government that the Senior Citizens have come to be sighing RELIEF from the cruel & ferocious clutches of the Accounts Officers & their negative web of Rules / Regulations ... IT IS TIME TO STRAIGHTEN THINGS THREE BENCHMARKS FOR MINIMUM PENSION MAY BE PRESCRIBED like 10, 15, 20 years service & stay of three-years at the last highest grade INSTEAD of the present HEGEMONIC-SYSTEM .
AGPR may be made duty-bound to transfer all Increases, Benefits like COMMUTATION, BENEVOLENT FUND, GROUP INSURANCE etc. into the Pensioner's Accounts through the DCS/BANKS ... The present system of year after years of Ignored-Applications & Fruitless-Visits of The Complainants with EMPTY-POCKET to the Islami AGPR may be ordered to be STOPPED forthwith & changed to the system inline with that of the kafirs under which THE RIGHTS have not to be begged ... Muk-Mukaa, sufferings & injustices should be ensured to be eliminated & a computerised shrunk AGPR MAY BE DECLARED A WELFARE DEPARTMENT overseen by an Honourary Advisory Council of seven pensioners !

PENSIONS in contempt of Court-Orders .

101 W.P No. 627-A of 2018 Sher Afzal Khan VS Govt of KPK Right to pension is conferred by law, which cannot be arbitrarily abridged or reduced except in accordance with law, as it is the vested right and legitimate expectation of retired civil servant. Petitioner was held entitled for pensionary benefits from the date of his retirement.

MIAN SAQIB NISAR, CJ.- These Suo Motu proceedings
initially arose when a large number of complaints were submitted to the Human Rights Cell of this Court, wherein retired employees ofvarious departments complained about non-payment of their
pensionary benefits. We took notice of the same and the case was first heard as SMC No.20/2016 on 14.11.2016

25. The question is once pension is being paid, whether under statutory provision, common law or contract, can it be in an amount so modest that it denies the pensioner a decent living,
thereby denying him/her the right to life? Article 14 of our
Constitution provides protection to the citizens of our country. Dignity of man shall be inviolable as envisaged in Article 14 of the Constitution. If a man serves his employer for a number of years, during the prime of his life and gives of his honest labour to his employer and where he is promised pension, whether under statute, common law or contract then he should be able to plan his financial future for his declining years keeping in mind such promises of a pension. When that pension is given but is of a sum which is illusory and by no amount of prudent budgeting can it be used to sustain a man independently, and forces him to turn to his children or other relatives/sources for ‘help’, offends against his dignity. To subject a pensioner to a life of penury and impoverishment, is a clear violation of his fundamental rights to life and dignity as enshrined in Articles 9 and 14 respectively. The entitlement to pension is not a fundamental right but must be duly earned. Once that right has been perfected and earned, as has been by the petitioners, it is no longer a question
S.M.C.No.20/2016 etc. -: 30 :-
whether they are entitled to the pension or not. The fundamental right that is to be enforced is that the pension given to such pensioners must be of a level which allows them to keep body and soul together.

Possible solutions of the CASE of Mr.Hasan Akhtar (Grade 19) not being attended to for the last over 2 years by the AGPR
(1) Ab-initio Reappraisal of The Case by the AUDITOR GENERAL & fixation of pension in the light of Notification prevalent in 1990 providing 2% incentive for going on Pre-mature Retirement after completion of 25 years service .
(2) Charge-sheet the AGPR for failing in performing their duty .
(3) Write-off the Time-Barred amount .
(4) Recover the AMOUNT at the speed it was disbursed over a span of 30 years .
... Human Rights CELL of the Supreme Court may also kindly see, RECOVERY ORDER OF Rs.15 Lakhs after 30 years ( alleged to be overpayment ) resulting in misery to the PENSIONER of 82 years of age, is in contempt of the Supreme Court Orders !
