Dont get me wrong, I think there needs to be accountability on the water as well as on land, but I believe Florida's BUI laws are not appropriate. The checks are ok, but if you take someone in and do a breathe sample, and it comes back below the limit, they should be released. I saw a video the other day where a man was arrested, taken to the station, gave a breathe sample, blew 0.00, and still was arrested for BUI. I call B.S. on that.

Happy to announce that my brothers case was dismissed today!

In the beginning of the video you can hear the cop mumble, let’s get them, if i see it I’ll nail it. They had no reasonable suspicion and then disguised their dui check as a vessel safety inspection.

Also the FST did not hold as external weather conditions a proper FST could not be done but was done anyway.

It was definitely eye opening into the legal system and i feel bad for people who aren’t able to afford attorneys and just end up staying in the same system for years because of one instance like this.

No matter what anyone thinks there was no reasonable suspicion to stop us and then act like an asshole to trip everyone up and assume we’re drunk.

This was us out on the boat, there was a bad storm coming and we were trying to quickly get our stuff together and get back to the dock. We had maybe moved 50 feet from our anchor spot just moving away from all the boats. None of us had much to drink all day and we got there at 7am and this was around 2:30pm. I was driving the boat and my brother was only behind the wheel for a minute while i got the boat in a safe condition. During those 2 mins he was behind the wheel, the boat was barley moving. They made him do the field sobriety test in 20 mph wind gust and pouring rain on a boat. Really stupid considering his excuse for even doing the field sobriety test was him failing to do his instructions properly, which he made him nervous when he started making up stuff he didn’t actually say. Overall we should of been more responsible and situational aware of our surroundings and being smarter all together.
