A Writ of Habeas Corpus is a post-conviction remedy. You're asking a court to re-open the case for some reason whether be ineffective assistance of counsel, [00:00:16] good job and that ineffectiveness caused you to be convicted or perhaps a newly discovered evidence. But a writ is basically [00:00:26] remedy allowing the court to re-open the case and even set aside the conviction if mistakes were made but a writ is only available if you're restrained.

There has to be some restraint whether you're in custody, you're movement is restricted obviously, or if you're on probation, or if you're on parole. Your movement is restricted, you have writ rights. However, once you're off probation, off parole, no longer in custody, then you can no longer attack the conviction itself.
