In Victoria, under the Road Safety Act 1986, Road Safety (Drivers) Regulations 2009, and the Road Safety Road Rules 2009, the use of mobile phones or other devices while driving is very restricted and significant penalties may apply.

Use of a mobile phone while driving has been found to be the cause of many road accidents, some fatal. If you look away from the road for even 2 seconds, your crash risk doubles. The aim of this law is to prevent such accidents.

My question is what classifies as a "commercially designed phone holder"?
With the new phone detection cameras coming out, I wonder if Kmart phone cradles or Quad Lock phone holders count.

Or for example, I work as a postie. And don't always have a phone holder in the van I use. So I put the AusPost scanner (which is basically an android phone) in the cup holder of the vehicle for navigation.

Apparently if your phone is on the passenger seat you can get done. What about if you press a button the inbuilt sound system. the rules regarding smartwatches are ridiculous. I can see alot of cases being thrown out in court and cops fined for wasting court time.
