There isn’t a difference. It’s just what the state wants to call drunk driving. In Texas it’s dwi in Missouri it’s dui

In Colorado there is also DWAI Driving While Ability Impaired but under .08 BAC, this means while you're not at the DUI per se legal limit, due to your weight or tolerance etc for alcohol or the drugs in your system your ability to drive was impaired, it is a lesser included charge of DUI and one that most people plea to when charged with DUI since Colorado has an anti plea deal statute that doesn't allow one to plea out of an alcohol related charge without a good faith representation by the DA that they would be unable to get a conviction for an alcohol or drug related offense

In college at Oregon State U I knew people that got BUI’s for my first two years until they changed it to DUI since Bicycles are considered vehicles and follow the same laws.

Where im from DUI means you where operate a vehicle with a BAC up to .07 Anything from .08 and up is DWI. Both charges are serious but a DWI obviously is more so.

This is what happens when attorneys and not regular people, wrote your laws. Over time they arbitrarily lower the BAC to get more people hemmed up into the system. It’s sick.

How about instead of charging someone with an acronym that can ruin their lives, mandate group therapy AA, counseling, twice a week, and any fall backs is mandated 3 days sobriety in a psych ward because obviously they have an illness?
I'd much rather see these people sober than made a stain on society with some charge that never drops and makes their life worse.

Should people with CDLs refuse the field sobriety test and the breathalyzer while driving a car?? I know refusal in the truck is bad but don't know about driving a car??

NONE of these are acronyms. They can NOT be pronounced as words. (Nobody actually says "dwee" for DWI.) They are all INITIALISMS.

OUI EVERYWHERE!! It's medical and federally coded, and required.. it's very very simple. Never live a full life ya may never need a medication like mine.. and I do mean MAY NEVER NEED. She should have judged someone else on a military base somewhere else..

These lawyers really need to spend some time researching the terms. Yes operating and driving are the same action. The problem is they are both defined at commercial transportation actions. If you are not in a commercial capacity then you are not driving or operating. These terms are defined in Blacks law dictionary and Bouviers law dictionary, books used by the Supreme Court as source documents of language that; define actions and terms by their usage over 1000s of years and thru 100s of source documents over time written by governments or experts on the subject.

Here they use all those at once to give you minimum of 2-4 charges for a single occurance. That which they will drop "one" of those in a plea for the illusion that you get a deal. We all know they mean the same, but list all of those on one occurance....made up BS for money machine.

Why are there so many laws different in each state in the US? The United States of America is very divided when it comes down to law and in what State you're in, or is that a wrong view from a foreigner?
