Because they have no other law in place for the state.

If they want that law to change, legislate a NEW law.

It's astounding to me that politicians, governors, Congress etc don't know how to remedy what they consider an outdated law.

In many cases, including this case, the courts just appear to be telling people what the law is. If legislators wanted they could just change it. But they don't so they don't. This applies at every level, from the US Congress, which chose for 50 years to not codify Roe, to the Alabama and Arizona legislatures. If people want it they just need to vote for legislators who will make it so. But they also don't so they don't.

Cool. They should send their Supreme court in a time machine back to 1864. These people are so ignorant they don't even know what year it is and how things have changed. The couple thousand people that lived in Arizona back then didn't care less about the issue.
