Thats not true. It's legal because the costal law doesn't apply in port lands where the hotel was build.

It's in a harbor on a breakwater of the harbor. Not the normal definition of "shoreline", which is why they allowed it to be built.

They knew that it was illegal when they built it but they knew that they would get away with it.
The law, La Ley de Costas, is not applied to rich property developers and hotel businesses. It's applied to normal citizens who don't have money to defend themselves.
In 2012 a whole village originally built by and for fishermen some 200 years ago was pulled down in Tenerife under application of the 'Coast Law'.
It was called Cho Vito and it was next to la Candelaria. They built hotels or tourist apartments there afterwards.

I knew someone that built an entire 3500 sq ft house within 10 feet of a creek that was approved by the county and city. House was completely built and basically move in ready when the feds shut it down. They said that he was not allowed to build within 100 feet of that water and battled it out in court for over 3 years. He ended up losing and basically lost the $600k he put in to the house, and was fined an additional half mil from the county/state/fed governments. He ended up filing for bankruptcy and leaving the country.

The same happened in Chicago with the construction of Lake Point Tower. At the time the landowners somehow made a clever move to allow the construction of the building to be completed even though it was violating a law that prohibited any construction built next to Lake Michigan. Till this day Lake Point Tower is the only building that is next to Lake Michigan.

I think it should be Publicly owned and the money it earns be put back into the environment, social programs and cultural institutions. The owners should be paid a sort of leasing agreement that can never be broken.

If itis illegal it should be closed and demolished. Public ground is not to be used for private businesses. Why does nobody recognized the mistake and allowed the construction? That sounds after corruption!
