Procedure of arrest and duties of officer making arrest
Every police officer while making an arrest shall,-
wear an accurate, visible and clear identification of his name which will facilitate easy identification;
prepare a memorandum of arrest which shall be,-
attested by at least one witness, who is a member of the family of the person arrested or a respectable member of the locality where the arrest is made;
countersigned by the person arrested; and
inform the person arrested, unless the memorandum is attested by a member of his family, that he has a right to have a relative or a friend named by him to be informed of his arrest.

Section 41B : गिरफ्तारी की प्रक्रिया और गिरफ्तार करने वाले अधिकारी का कर्तव्य

Section 41 B(a) : प्रत्येक पुलिस अधिकारी गिरफ्तार करते समय अपने नाम का सही प्रकट और स्पष्ट पहचान धारण करें जिससे आसानी से उसकी पहचान हो सके

Section 41B(b): Memo of Arrest या Memorandum of Arrest, एक तरह का फॉर्म होता है उसको भरेगा जिसके अंदर कुछ details होती है जैसे कि उसे किस अपराध के लिए गिरफ्तार किया गया और कौन सी जगह पर गिरफ्तार किया गया है कौन से अधिकारी उसे गिरफ्तार किया है इस सारे details उसके अंदर रहती है

Section 41B(b)(1): कम से कम एक Witness द्वारा उस Memo of arrest एक attest किया जाएगा जो गिरफ्तार किए गए व्यक्ति के परिवार का सदस्य हो या कोई respected person हो उस local society का जहां पर उसे गिरफ्तार किया गया है

Section 41B(b)(2) : गिरफ्तार किए गए व्यक्ति की Memo of arrest पर उसका काउंटर साइन भी लिया जाएगा

Section 41B(c) : जब Memorandum of Arrest किसी व्यक्ति द्वारा attest नहीं किया जाता है तो ऐसे में पुलिस अधिकारी का कर्तव्य बनता है कि गिरफ्तार किए गए व्यक्ति की सूचना उसके किसी मित्र या किसी परिवार के सदस्यया वह जिसे चाहे उस व्यक्ति को सूचित करें
