Wage Theft: Not Being Paid What You're Owed - Employment Attorney Adam Gonnelli
(877) 247-4292

Employment attorney Adam Gonnelli discusses how more employees are falling victim to a crime committed by their own employer.

As your employer has to make sure they are not getting scammed by employees by workers "eating the clock" or taking money, they also have to cause you no harm as well. Employers have to make sure that they treat you fairly as well.

Wage theft is the act in which employers do not pay you for the work that you do. Examples of this could you being forced to work while off the clock, sharing tips and working through lunch but getting deducted for that time. Wage theft can happen in any type of job or industry including food service, healthcare and even finance. Whatever your job is you deserve to get paid for any and all hours that you work. I’ve had to sue many former employers for wage theft, sexual harassment, intentional infliction of distress, emotional stress, assault, discrimination, etc.

I am in a situation where my job does not pay me for every bit of money that is owed to me. I work in sales, and I noticed that money from meetings, coachings, even sales I had made had been missing from my paycheck. I went to HR to discuss the matter, and my senior manager apologize for the discrepancy. Than a couple of weeks later, I was promise a 2000 dollar check and was giving a 1600 dollar pay check again. So I went down to the Senior Manager to asked him about it, showing him evidence, and he said he'll look into it. A week and a half has gone by. He walked to my cubicle and explain the higher ups decided to change the metric system again and because of it, that is the money you have earned for the time being. In my head, I called him a crock of shit. From them on ever since than, I noticed my paycheck become less and less to the place where now, I'm lucky if I bring in a 1000 dollar check. I'm not sure if they are doing this to me because, at the same time I reported my boss to HR for harassment, and constant signs of physical aggressions towards me or other team members or if it's because they want me to eventually quit because they do not want to pay me. Oh btw, the last straw for me has been this Thanksgiving where I was told if I worked the day before and after the holiday, I will receive a bonus on my paycheck, only that did not happen. Is this enough evidence to report my company to EEOC?

Thank you for what you do. You don’t appreciate people like you until this happens to you personally.

My employer lied to me about what I was getting paid per hour. I've been here for over a year and I don't make over 1$ more than what I started out making. He's also been screwing me out of money weekly because he pays me cash and his math comes NOWHERE close to my math. Ex- last week I worked alone and did 4 80+ case orders alone plus did my normal job and when I got paid it was barely 200$.

when I worked for target I stole thousands in electronics, dvds, food from the food court, and small change (they don't count coins at the end of the day), I would even punch out an hour or two later than my scheduled shift each day and they never fucking caught on. it's not hard to fight back, you just gotta be smart.

I work at the Raritan Valley Work Center. I've worked hard for 2 weeks and didn't get a paycheck for it. It's very devastating. It's like "work hard, get nothing" at my workplace.

As ive expressed monetary compensated for services rendered as in any production of work with my name attached as well as any work expected, mentally or regarding intellectual property and as I've reiterated i expect proper monetary compensation, lack of payment would be against my rights which would be forced labor;

Had this to happen to me. Need advice. A major app used by many paid me for one day "only" for a weekend of work under a staffing agency (the staffing agency is the app this time...hint). And after getting the "go ahead correction" I worked again for another weekend, but I believe they are trying to do this again after her basically saying 7 hours when clearly she already stated that Sunday hours would go on next pay period. Keep in mind I do work a full time job as well and this isn't easy. So..., now.... back to this unique pay period.... it's NOT in the system. The client shows that they paid me for two days for Sat.... and Sun. Mon-Sun not Sun-Sat. The hiring manager... is avoiding calls and emails and states that the pay period is different from the client ...what???? Okkkk("If, so" "benefit of the doubt")....hhmmm, but when I ask you for a pay stub you can't give me correct hours or a stub and the wrong pay period is clearly still in your system that's how you got to 7 hours right??? O... wait that means I should've gotten paid... O no I mean.... I should have more than one day on this new unique pay period that should have a stub... O wait why did you say only 7 hours again???? And I had to correct you... Yea, not buying it. I reached out to other branches of this agency (I call them to call her to call me.. .wow!! and we talking about like only 3 calls) and they even stated that the pay period should match the client. Now, this client has a specific employee over the staffing agency when she is called she avoids calls and drops calls that are forwarded...hmm... everybody states that time cuts off Sunday not Saturday... these are temps and direct hires... as also stated on the "supposedly" incorrect pay stub in the app, which they paid me just for Sat. not Sun on. This is a MAJOR client and APP talk about class action lawsuit for any takers... I was told this happened to others, but I do feel like this was a single attack initially and payment has probably already been corrected for others (I will explain this if advice can be through better means). Information can't be affirmed to know what the real pay period is... everything goes through this one hiring manager for that location, grandprairie, tx.... But she isn't the head. She stated as much herself about correcting this "app issue" o, but it's now a stub issue I mean.. I don't believe the staffing agency knows anything and if they do that just affirms my statements. This could be big for any legal department or individual that has access to legal I have proof and if you are willing to deal with more... even bigger... I'm talking two years of burden bigger with probably big names or titles the sky is the limit. This mess needs to stop!!!! I never use to have problems like this. I must warn any takers you will be probably oppressed, stalked, contacted after this post, slandered (this post may even be... counting on it) etc... etc..., but if you're in the legal department this would NOT surprise you or if you know someone in legal and you guys "really" chat... then it wouldn't surprise you. Find a way to help and I promise I will help.

I would like to inquire whether it would be considered wage theft if an employee is offered a compensation of $19 per hour on the condition that they complete the entire 40-hour workweek, but only $14 per hour if they fail to do so.

Right now I am owed $69, 550.00 in wages. I've been hearing for the last 2 years  when the house sells, you'll be paid. I am literally a prisoner of my employer. Isn't domestic Slavery illegal? I work as a caregiver/maintenance in the home of a 92 year old gentleman. His house was in need of repairs. The gentleman paid me 0nly $50.00 per week for the first year and finally $100 per week the 2nd. 2 of his children have told me I would be compensated eventually. I'm tired of being taken advantage of and need help. What do I do? I cant afford an attorney. I cant even afford to move out. Help!

Hiring agency said check was mailed out early in the week, its Saturday and still no check, can I sue the company that I did the work for? The company told me that they do business with the agency on a regular basis. The company made 5, 000-8, 000 from my labor and I didn't get paid . Shouldn't they be liable?
