Wife issued bounced bank cheque with the help of her husband were nominated in FIR by the complainant. During Investigation both accused were initially presented before police and recorded their statements. Police submitted chalian US 173 mentioning therein both accused on bail. /Subsequently female accused after appearing before Magistrate absconded. Court started trial and framed charge in presence of one accused only. The magistrate after conclusion of the trial proceeding acquitted both accused while female who was shown on bail in chelan by the police and process issued under section 87 and 88 against the said female accused who declared absconded acquitted by the Mavistrate along with Male accused. No proceeding under sect IK on 512 was proceeded in absence of that absconder accused but magistrate acquitted to both accused. It this judgment correct or liable to be remanded in appeal by H.C.
