You seem to be unaware that Big West has challenged Harmony Gold on their unscrupulous trademarks on Macross in court for the past several years. They won their lawsuits in Australia and the UK. They also acquired their trademark in China. And the latest was in the EU which was in the verge of ending in Big West's favor. Harmony Gold could only file for appeals which was getting them nowhere. Instead of pursuing their appeal HG decided to negotiate with BW and settle off-court. And this agreement is how it resulted. Clearly this was heavily in Big West's terms as they had far more resources and legal leverage than Harmony Gold with the Macross IP.

I do recall what started the lawsuit Bigwest was planning to release video Macross VFX-2 on PS1 in the west and Harmony Gold claim copyright of the game this caused a huge impact on its chance to have Macross in 2000.
