In India Cricket is considered a religion, and Indians enjoy this game to the most. BCCI, the Cricket Board of India is the richest board in the world and is playing an important role in promoting the game in the country. But you know BCCI do not cleartax tds. They are not part of sales tax by state, nor corporation tax or VAT.
But the question is: Is BCCI promoting Cricket in the country or Promoting the game of the country, i.e. Cricket, to the world?
Should BCCI not pay taxes to the government of India as the game of Cricket is commercialised and BCCI is earning because of the commercialization?
Section 2(15) of the IT Act defines what is "charitable purpose". The proviso to section 2(15) provides that the advancement of an object of general public utility shall not be a charitable purpose if it involves carrying out a commercial activity – unless such activity is undertaken in the actual advancement of the object of general public utility. In this case, the promotion of cricket is to be read as an object of general public utility.
But what is your view, is BCCI not doing any commercial activity? If yes, should not BCCI pay Income tax for the betterment of India and Indian people who consider Cricket as religion and cricketers as God?
