In a "drunk in public" arrest, are police required to give you a blood or breath test? No, explains our former cop turned defense lawyer. In a DUI case, the suspect is entitled to take a chemical test of his blood, breath or urine. But not in a Penal Code 647f drunk in public intoxication case. This can work to the detriment of the suspect, because if the police officer exaggerates in describing the symptoms of intoxication, the person has no way of proving otherwise via a chemical test.

Hey this is really important i am 16 and was at a high school party and the cops broke it up and we were all drinking, the cops gave several kids rides home including me, all they got was a slap on the wrist but i was cited, not arrested for drunk in public but the party was out in rural area on private property what do i do
