If they're not a Citizen, they don't receive the benefits of the Constitution, 2a Rights included.
The Constitution applies only to those who've adopted the Constitution in their hearts.
Sure, there's diplomatic immunities; but those can only go so far.

For example, if a diplomat gets attacked and kills the attacker, the diplomat is given the most argumentative power in regards to a murder charge.

But if the diplomat is committing crimes, threatening people because of the power they think they have, that diplomat has gone rouge and forfeits all immunities.

The Constitution is above all treaties, as per the Constitution. So if a diplomat crosses the Constitution, they get beat with a stick.
