The reason why the death sentence was abolished in the UK - too many miscarriages of justice and it’s still going on - scary stuff if you stand accused of a crime you know you’re not guilty of!

The important thing you’ve overlooked is the dilution of certainty which came in in 1967 when the idea of a majority verdict was brought in, prior to that a jury in a criminal trial was required to be unanimous. That too, affects the hurdle the prosecution needs to achieve as they don’t need to persuade everyone to be sure. “So that you are sure” was not meant to change the standard of proof but to just be a clearer articulation of what “beyond all reasonable doubt” means, but to me, the latter phrase is a clearer statement but maybe the former helps a lay person….

Before applying to be a magistrate I attended court cases. I am a scientist, requiring convincing evidence (5 sigma in the case of the Higgs Boson) and was appalled at the low standard accepted by magistrates and juries. I was also astonished by the lack of logical skills applied. I used to try to convert some of the arguments into predicate calculus, not only because it showed up faulty logic, but it also revealed implicit assumptions.

The justice system relies on the juror's belief that it is not reasonable to doubt the sincerity and integrity of the justice system (prosecutors and judges). It is not reasonable to doubt the justice system itself.

I think the standard of my being sure could be significantly higher than being beyond reasonable doubt. I don't even have to put myself in the mind of a reasonable person. I'm instructed to decide unapologetically as the hyper-pedantic and sceptical person I am by nature.
